  1  1    Amend the amendment, S-5437, to Senate File 2293,
  1  2 as follows:
  1  3    #1.  Page 1, by inserting after line 17 the
  1  4 following:
  1  5    "Sec.    .  Section 200.18, subsection 2, Code
  1  6 2001, is amended to read as follows:
  1  7    2.  A person violating this chapter, other than
  1  8 section 200.23, or rules adopted by the secretary
  1  9 pursuant to this chapter shall be guilty of a simple
  1 10 misdemeanor.  However, a person who tampers with,
  1 11 possesses, or transports anhydrous ammonia or
  1 12 anhydrous ammonia equipment commits a serious
  1 13 misdemeanor under section 124.401F.
  1 14    Sec.    .  NEW SECTION.  200.23  MUNICIPAL
  1 15 FERTILIZER APPLICATION.
  1 16    1.  A person shall not apply a fertilizer to
  1 17 property which meets all of the following criteria:
  1 18    a.  The property is located in a city.
  1 19    b.  The property is within fifty feet of any creek,
  1 20 stream, river, drainage ditch, pond, or lake in this
  1 21 state.
  1 22    2.  A person who violates a provision of this
  1 23 section is subject to a civil penalty of five hundred
  1 24 dollars for each violation.
  1 25    3.  This section shall not apply to the application
  1 26 of a fertilizer to property which is agricultural land
  1 27 that is principally used for farming as those terms
  1 28 are defined in section 9H.1.
  1 29    Sec.    .  Section 206.22, subsection 2, Code 2001,
  1 30 is amended to read as follows:
  1 31    2.  Any person violating any provision of this
  1 32 chapter other than section 206.11, subsection 1,
  1 33 paragraph "a", or section 206.26, shall be guilty of a
  1 34 serious misdemeanor; provided, that any offense
  1 35 committed more than five years after a previous
  1 36 conviction shall be considered a first offense; and
  1 37 provided, further, that in any case where a registrant
  1 38 was issued a warning by the secretary pursuant to the
  1 39 provisions of this chapter, such registrant shall upon
  1 40 conviction of a violation of any provision of this
  1 41 chapter other than section 206.11, subsection 1,
  1 42 paragraph "a", or section 206.26, be guilty of a
  1 43 serious misdemeanor; and the registration of the
  1 44 article with reference to which the violation occurred
  1 45 shall terminate automatically.  An article, the
  1 46 registration of which has been terminated, may shall
  1 47 not again be registered unless the article, its
  1 48 labeling, and other material required to be submitted
  1 49 appear to the secretary to comply with all the
  1 50 requirements of this chapter.
  2  1    Sec.    .  NEW SECTION.  206.26  MUNICIPAL
  2  2 PESTICIDE APPLICATION.
  2  3    1.  A person shall not apply a pesticide to
  2  4 property which meets all of the following criteria:
  2  5    a.  The property is located in a city.
  2  6    b.  The property is within fifty feet of any creek,
  2  7 stream, river, drainage ditch, pond, or lake in this
  2  8 state.
  2  9    2.  A person who violates a provision of this
  2 10 section is subject to a civil penalty of five hundred
  2 11 dollars for each violation.
  2 12    3.  This section shall not apply to the application
  2 13 of a pesticide to property which is agricultural land
  2 14 that is principally used for farming as those terms
  2 15 are defined in section 9H.1."
  2 16    #2.  Page 54, line 3, by inserting before the word
  2 17 ", providing" the following:  "and the environment".
  2 18    #3.  By renumbering, redesignating, and correcting
  2 19 internal references as necessary.
