  1  1    Amend Senate File 2330 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  NEW SECTION.  331.386  REGIONAL
  1  5 TRANSIT DISTRICT AUTHORIZED – DEFINITION – FINANCE
  1  6 AUTHORITY.
  1  7    1.  DEFINITION.  As used in this section, unless
  1  8 the context otherwise requires, "regional transit
  1  9 district" means a public transit district created
  1 10 pursuant to an agreement pursuant to chapter 28E by
  1 11 one or more counties or cities to provide support for
  1 12 transportation passengers by one or more public
  1 13 transit systems designated under chapter 324A.
  1 14    2.  REGIONAL TRANSIT DISTRICT CREATED.
  1 15    a.  One or more counties may create a regional
  1 16 transit district consisting of  the area of any
  1 17 participating county outside cities served by an urban
  1 18 transit system and the incorporated area of any
  1 19 participating city.  The areas included in a regional
  1 20 transit district need not be contiguous, but the
  1 21 parties to a chapter 28E agreement creating a regional
  1 22 transit district shall include at least one county,
  1 23 plus any of the following:
  1 24    (1)  Any contiguous counties which choose to
  1 25 participate.
  1 26    (2)  Any cities which choose to participate,
  1 27 provided the cities are located within a participating
  1 28 county or within a county contiguous to a
  1 29 participating county or to a county with at least one
  1 30 participating city.
  1 31    b.  The governing body of a regional transit
  1 32 district has all the rights, powers, privileges, and
  1 33 immunities of a local government relating to the
  1 34 purpose for which the regional transit district is
  1 35 created.  In exercising its powers, the governing body
  1 36 may establish a schedule of fares and collect fares
  1 37 for the transportation of passengers.
  1 38    3.  TAX AUTHORITY.  The governing body of a
  1 39 regional transit district may impose a tax levy which
  1 40 shall not exceed the rate of ninety-five cents per
  1 41 thousand dollars of the assessed value of all taxable
  1 42 property in the regional transit district.  The
  1 43 proceeds of the tax levy shall be used for works and
  1 44 facilities useful for the transportation of passengers
  1 45 who present themselves for transportation without
  1 46 discrimination up to the capacity of each public
  1 47 transit vehicle.  The governing body of a regional
  1 48 transit district may divide a regional transit
  1 49 district into separate service areas and impose a
  1 50 separate levy not to exceed the maximum rate
  2  1 authorized in this subsection in each service area.
  2  2 If a city is included in a regional transit district,
  2  3 the tax levy authorized pursuant to section 384.12,
  2  4 subsection 10, shall be reduced by the tax levy
  2  5 imposed by the regional transit district within the
  2  6 city or part of the city pursuant to this subsection.
  2  7 A tax levy imposed pursuant to section 384.12,
  2  8 subsection 10, and this subsection shall not exceed
  2  9 the aggregate of ninety-five cents per thousand
  2 10 dollars of the assessed value of all taxable property
  2 11 in a participating city.
  2 12    4.  BONDING AUTHORITY.
  2 13    a.  The establishment, construction,
  2 14 reconstruction, repair, equipping, remodeling,
  2 15 extension, maintenance, and operation of works,
  2 16 vehicles, and facilities of a regional transit
  2 17 district may be financed by revenue bonds as a county
  2 18 enterprise pursuant to division IV, part 4.
  2 19    b.  The establishment, construction,
  2 20 reconstruction, repair, equipping, remodeling,
  2 21 extension, maintenance, and operation of works,
  2 22 vehicles, and facilities of a regional transit
  2 23 district may be financed by general obligation bonds
  2 24 as an essential county purpose pursuant to division
  2 25 IV, part 3.
  2 26    Sec.    .  Section 331.441, subsection 2, paragraph
  2 27 b, Code Supplement 2001, is amended by adding the
  2 28 following new subparagraph:
  2 29    NEW SUBPARAGRAPH.  (15)  The establishment,
  2 30 construction, reconstruction, repair, equipping,
  2 31 remodeling, extension, maintenance, and operation of
  2 32 works, vehicles, and facilities of a regional transit
  2 33 district.
  2 34    Sec.    .  Section 331.461, subsection 2, Code
  2 35 Supplement 2001, is amended by adding the following
  2 36 new paragraph:
  2 37    NEW PARAGRAPH.  h.  A regional transit district
  2 38 including the establishment, construction,
  2 39 reconstruction, repair, equipping, remodeling,
  2 40 extension, maintenance, and operation of its works,
  2 41 vehicles, and facilities.
  2 42    Sec.    .  Section 384.12, subsection 10, Code
  2 43 2001, is amended to read as follows:
  2 44    10.  A tax for the operation and maintenance of a
  2 45 municipal transit system, and for the creation of a
  2 46 reserve fund for the system, in an amount not to
  2 47 exceed ninety-five cents per thousand dollars of
  2 48 assessed value each year less the rate of tax levied
  2 49 for a regional transit district, when the revenues
  2 50 from the transit system are insufficient for such
  3  1 purposes, but proceeds of the tax may not be used to
  3  2 pay interest and principal on bonds issued for the
  3  3 purposes of the transit system."
  3  4    #2.  Title page, line 3, by inserting after the
  3  5 word "counties," the following:  "authorizing the
  3  6 imposition of a limited tax levy,".
  3  7    #3.  By renumbering as necessary.
