1 3 as follows:
1 4 #1. Page 1, by inserting after line 2 the
1 5 following:
1 6 "# . Page 1, by inserting after line 4 the
1 7 following:
1 8 "Sec. . Section 85.26, subsection 2, Code 2001,
1 9 is amended by striking the subsection and inserting in
1 10 lieu thereof the following:
1 11 2. If an award for payment of benefits under
1 12 chapter 85, 85A, or 85B has been filed by the workers'
1 13 compensation commissioner, and not commuted, or if an
1 14 agreement for settlement pursuant to section 86.13 has
1 15 been filed with and approved by the commissioner and
1 16 not commuted, or if within six months of the
1 17 commencement of any kind of disability benefits a
1 18 denial of liability has not been filed with the
1 19 commissioner and notice of the denial delineating the
1 20 grounds of denial has not been mailed to the employee
1 21 in the form and manner required by the commissioner,
1 22 the amount of benefits due by an employer to an
1 23 employee may be reviewed at any time upon commencement
1 24 of reopening proceedings by the employee.""
