  1  1    Amend the House amendment, S-5272, to Senate File
  1  2 2190, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 2, by inserting after line 45 the
  1  5 following:
  1  6    "#   .  Page 3, by inserting before line 7 the
  1  7 following:
  1  8    "Sec.    .  Section 85A.12, unnumbered paragraph 1,
  1  9 Code 2001, is amended to read as follows:
  1 10    An employer shall not be liable for any
  1 11 compensation for an occupational disease unless such
  1 12 disease shall be due to the nature of an employment in
  1 13 which the hazards of such disease actually exist, and
  1 14 which hazards are characteristic thereof and peculiar
  1 15 to the trade, occupation, process, or employment, and
  1 16 such disease actually arises out of the employment,
  1 17 and unless disablement or death results within three
  1 18 years in case of pneumoconiosis, or within one year in
  1 19 case of any other occupational disease, after the last
  1 20 injurious exposure to such disease in such employment,
  1 21 or in case of death, unless death follows continuous
  1 22 disability from such disease commencing within the
  1 23 period above limited for which compensation has been
  1 24 paid or awarded or timely claim made as provided by
  1 25 this chapter and results within seven years after such
  1 26 exposure.""
