  1  1    Amend the House amendment, S-5272, to Senate File
  1  2 2190, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 1, by inserting before line 7, the
  1  5 following:
  1  6    ""Sec.    .  Section 85.33, subsection 4, Code
  1  7 2001, is amended to read as follows:
  1  8    4.  If an employee is entitled to temporary partial
  1  9 benefits under subsection 3 of this section, the
  1 10 employer for whom the employee was working at the time
  1 11 of injury shall pay to the employee weekly
  1 12 compensation benefits, as provided in section 85.32,
  1 13 for and during the period of temporary partial
  1 14 disability.  The temporary partial benefit shall be
  1 15 sixty-six and two-thirds percent of the difference
  1 16 between the employee's weekly earnings at the time of
  1 17 injury, computed in compliance with section 85.36, and
  1 18 the employee's actual gross weekly income from
  1 19 employment during the period of temporary partial
  1 20 disability.  If at the time of injury an employee is
  1 21 paid on the basis of the output of the employee, with
  1 22 a minimum guarantee pursuant to a written employment
  1 23 agreement, the minimum guarantee shall be used as the
  1 24 employee's weekly earnings at the time of injury.
  1 25 However, the weekly compensation benefits shall not
  1 26 exceed the payments to which the employee would be
  1 27 entitled under section 85.36 or section 85.37, or
  1 28 under subsection 1 of this section."
