  1  1    Amend the House amendment, S-5272, to Senate File
  1  2 2190, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 2, by inserting after line 45 the
  1  5 following:
  1  6    "#   .  Page 3, by inserting before line 7, the
  1  7 following:
  1  8    "Sec.    .  Section 85.70, Code 2001, is amended to
  1  9 read as follows:
  1 10    85.70  ADDITIONAL PAYMENT FOR ATTENDANCE.
  1 11    An employee who has sustained an injury resulting
  1 12 in permanent partial or permanent total disability,
  1 13 for which compensation is payable under this chapter,
  1 14 and who cannot is unable to return to gainful
  1 15 employment in the job the employee held at the time of
  1 16 the injury because of such disability, shall upon
  1 17 application to and approval by the workers'
  1 18 compensation commissioner be entitled to a twenty-
  1 19 dollar weekly an additional worker training payment
  1 20 from the employer.  The worker training payment shall
  1 21 be in addition to any other benefit payments to the
  1 22 employee, during each full week in which the employee
  1 23 is not receiving healing period benefits pursuant to
  1 24 section 85.34, and is actively participating in a
  1 25 vocational rehabilitation program recognized by the
  1 26 vocational rehabilitation services division of the
  1 27 department of education or participating in any other
  1 28 training program, including apprenticeship training,
  1 29 recognized by the department of education.  The
  1 30 additional worker training payment authorized by this
  1 31 section shall be in an amount determined in the same
  1 32 manner as healing period benefits are calculated
  1 33 pursuant to section 85.37.  The workers' compensation
  1 34 commissioner's approval of such application for
  1 35 payment may be given only after a careful evaluation
  1 36 of available facts, and after consultation with the
  1 37 employer or the employer's representative.  Judicial
  1 38 review of the decision of the workers' compensation
  1 39 commissioner may be obtained in accordance with the
  1 40 terms of the Iowa administrative procedure Act and in
  1 41 section 86.26.  Such additional benefit payment shall
  1 42 be paid for a period not to exceed thirteen
  1 43 consecutive weeks except that the workers'
  1 44 compensation commissioner may extend the period of
  1 45 payment not to exceed an additional thirteen ninety-
  1 46 one weeks if the circumstances indicate that a
  1 47 continuation of training will in fact accomplish
  1 48 assist the employee's rehabilitation.""
