  1  1    Amend the House amendment, S-5272, to Senate File
  1  2 2190, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 2, by inserting after line 45 the
  1  5 following:
  1  6    "#   .  Page 3, by inserting before line 7 the
  1  7 following:
  1  8    "Sec.    .  Section 85.70, Code 2001, is amended to
  1  9 read as follows:
  1 10    85.70  ADDITIONAL PAYMENT FOR ATTENDANCE.
  1 11    An employee who has sustained an injury resulting
  1 12 in permanent partial or permanent total disability,
  1 13 for which compensation is payable under this chapter,
  1 14 and who cannot return to gainful employment because of
  1 15 such disability which prevents the employee from
  1 16 returning to the same or similar employment, shall
  1 17 upon application to and approval by the workers'
  1 18 compensation commissioner be entitled to a twenty-
  1 19 dollar one-hundred-dollar weekly payment from the
  1 20 employer in addition to any other benefit payments,
  1 21 during each full week in which the employee is
  1 22 actively participating in a vocational rehabilitation
  1 23 program recognized by the vocational rehabilitation
  1 24 services division of the department of education.  The
  1 25 workers' compensation commissioner's approval of such
  1 26 application for payment may be given only after a
  1 27 careful evaluation of available facts, and after
  1 28 consultation with the employer or the employer's
  1 29 representative.  Judicial review of the decision of
  1 30 the workers' compensation commissioner may be obtained
  1 31 in accordance with the terms of the Iowa
  1 32 administrative procedure Act and in section 86.26.
  1 33 Such additional benefit payment shall be paid for a
  1 34 period not to exceed thirteen twenty-six consecutive
  1 35 weeks except that the workers' compensation
  1 36 commissioner may extend the period of payment not to
  1 37 exceed an additional thirteen twenty-six weeks if the
  1 38 circumstances indicate that a continuation of training
  1 39 will in fact accomplish rehabilitation.""
