1 6 facility bed-hold based on an analysis of nursing
1 7 facility cost, occupancy, and utilization."
1 8 #2. Page 130, by inserting after line 32, the
1 9 following:
1 10 "cc. For the fiscal year beginning July 1, 2002,
1 11 reimbursement for hospital crossover payments shall be
1 12 the lesser of the following:
1 13 (1) The medical assistance program allowed cost
1 14 amount minus the federal Medicare payment amount.
1 15 (2) The federal Medicare coinsurance and
1 16 deductible amounts."
1 17 #3. Page 136, by inserting after line 6, the
1 18 following:
1 19 "Sec. . NEW SECTION. 249A.20B NURSING
1 20 FACILITY CROSSOVER PAYMENTS.
1 21 Beginning July 1, 2002, reimbursement under the
1 22 medical assistance program for nursing facility
1 23 crossover payments shall be the lesser of the
1 24 following:
1 25 1. The cost amount allowed under the medical
1 26 assistance program minus the federal Medicare payment.
1 27 2. The federal Medicare coinsurance and deductible
1 28 amounts.
1 29 Sec. . NEW SECTION. 249A.21 INTERMEDIATE CARE
1 30 FACILITIES FOR PERSONS WITH MENTAL RETARDATION
1 31 ASSESSMENT.
1 32 1. The department may assess intermediate care
1 33 facilities for persons with mental retardation, as
1 34 defined in section 135C.1, that are not operated by
1 35 the state, a fee in an amount not to exceed six
1 36 percent of the total annual revenue of the facility
1 37 for the preceding fiscal year.
1 38 2. The assessment shall be paid to the department
1 39 in equal monthly amounts on or before the fifteenth
1 40 day of each month. The department may deduct the
1 41 monthly amount from medical assistance payments to a
1 42 facility described in subsection 1. The amount
1 43 deducted from payments shall not exceed the total
1 44 amount of the assessments due.
1 45 3. Revenue from the assessments shall be credited
1 46 to the state medical assistance appropriation. This
1 47 revenue may be used only for services for which
1 48 federal financial participation under the medical
1 49 assistance program is available to match state funds.
1 50 4. If federal financial participation to match the
2 1 assessments made under subsection 1 becomes
2 2 unavailable under federal law, the department shall
2 3 terminate the imposing of the assessments beginning on
2 4 the date that the federal statutory, regulatory, or
2 5 interpretive change takes effect.
2 6 5. The department of human services may procure a
2 7 sole source contract to implement the provisions of
2 8 this section."
2 9 #4. Page 142, by inserting after line 20, the
2 10 following:
2 11 "___. The section in this division of this Act
2 12 relating to the assessment on intermediate care
2 13 facilities for persons with mental retardation."
2 14 #5. By renumbering as necessary.
