PAG LIN 1 1 Amend House File 2506, as passed by the House, as 1 2 follows: 1 3 #1. Page 2, by inserting after line 8 the 1 4 following: 1 5 "Sec. . Section 901.5, Code Supplement 2001, is 1 6 amended by adding the following new subsection: 1 7 NEW SUBSECTION. 14. If the court defers judgment 1 8 or sentence or suspends the sentence, the court may 1 9 order as a condition of probation that the defendant 1 10 be subjected to searches under the same circumstances 1 11 and procedures that apply to parolees under section 1 12 906.4. 1 13 Sec. . Section 906.4, Code 2001, is amended by 1 14 adding the following new unnumbered paragraph after 1 15 unnumbered paragraph 3: 1 16 NEW UNNUMBERED PARAGRAPH. The board as a condition 1 17 of parole or work release may require a person submit 1 18 to a search of the person, the person's property, 1 19 place of residence, vehicle, or personal effects, at 1 20 any time, with or without a search warrant or probable 1 21 cause, by any peace officer for the duration of parole 1 22 or work release. For purposes of this section, "peace 1 23 officer" means those officers designated under section 1 24 801.4. 1 25 Sec. . NEW SECTION. 906.5A INFORMATION 1 26 PROVIDED TO STATE DEPARTMENT OF TRANSPORTATION AND LAW 1 27 ENFORCEMENT AGENCIES. 1 28 The board of parole shall notify the local law 1 29 enforcement agency with jurisdiction over the area 1 30 where a person is paroled and the state department of 1 31 transportation of conditions of the person's release 1 32 requiring the person to submit to a search as provided 1 33 in section 906.4 or 907.6. The state department of 1 34 transportation shall release such information to a law 1 35 enforcement agency as provided in section 321.11. 1 36 Sec. . Section 907.6, Code 2001, is amended to 1 37 read as follows: 1 38 907.6 CONDITIONS OF PROBATION REGULATIONS. 1 39 Probationers are subject to the conditions 1 40 established by the judicial district department of 1 41 correctional services subject to the approval of the 1 42 court, and any additional reasonable conditions which 1 43 the court or district department may impose to promote 1 44 rehabilitation of the defendant or protection of the 1 45 community. Conditions may include but are not limited 1 46 to adherence to regulations generally applicable to 1 47 persons released on parole and including requiring 1 48 unpaid community service as allowed pursuant to 1 49 section 907.13, or being subjected to searches 1 50 pursuant to section 906.4. The district department 2 1 assigned to supervise the probationer shall notify the 2 2 local law enforcement agency with jurisdiction over 2 3 the area where the probationer resides and the state 2 4 department of transportation of conditions of the 2 5 probationer's release requiring the probationer to 2 6 submit to a search as provided in this section. The 2 7 state department of transportation shall release such 2 8 information to a law enforcement agency as provided in 2 9 section 321.11." 2 10 #2.
