1 3 #1. Page 24, by inserting after line 33 the
1 4 following:
1 5 "Sec. . NEW SECTION. 97C.21 VOLUNTARY
1 6 COVERAGE OF ELECTED OFFICIALS.
1 7 Notwithstanding any provision of this chapter to
1 8 the contrary, an elected official otherwise excluded
1 9 from the definition of employee as provided in section
1 10 97C.2, may, but is not required to, choose to be
1 11 provided benefits as an employee as provided by this
1 12 chapter. This choice shall be reflected in the
1 13 federal-state agreement described in section 97C.3.
1 14 An employer who is providing benefits to an elected
1 15 official otherwise excluded from the definition of
1 16 employee prior to July 1, 2002, shall not be deemed to
1 17 be in an erroneous reporting situation, and
1 18 corrections for prior federal social security
1 19 withholdings shall not be required. The
1 20 implementation of this section shall be subject to the
1 21 approval of the federal social security
1 22 administration."
