  1  1    Amend House File 2532, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 21, by inserting after line 3, the
  1  4 following:
  1  5    "Sec.    .  Section 97B.80A, subsections 1 and 3,
  1  6 Code 2001, are amended to read as follows:
  1  7    1.  A vested or retired member who has five or more
  1  8 full calendar years of covered wages and who at any
  1  9 time was employed by a covered employer under this
  1 10 chapter but at the time of the employment was not
  1 11 covered by this chapter and did not opt out of
  1 12 coverage under this chapter in eligible public
  1 13 employment, upon submitting verification of the
  1 14 eligible public employment and the dates of the
  1 15 eligible public employment, may make contributions to
  1 16 the system for up to the lesser of twenty quarters of
  1 17 service credit for such eligible public employment or
  1 18 the entire period of the eligible public employment,
  1 19 in increments of one or more calendar quarters, and
  1 20 receive credit for membership service and prior
  1 21 service for the period of time for which the
  1 22 contributions are made.
  1 23    3.  The verification of the eligible public
  1 24 employment and the dates of such eligible public
  1 25 employment shall be made by the department prior to
  1 26 receiving contributions from the member.
  1 27    Sec.    .  Section 97B.80A, Code 2001, is amended
  1 28 by adding the following new subsection:
  1 29    NEW SUBSECTION.  7.  For purposes of this section,
  1 30 "eligible public employment" means employment of a
  1 31 person who at the time of the employment was not
  1 32 covered by this chapter and the employment meets any
  1 33 of the following conditions:
  1 34    a.  Employment by a covered employer under this
  1 35 chapter of a person who did not opt out of coverage
  1 36 under this chapter.
  1 37    b.  Employment of a person as an adjunct instructor
  1 38 as defined in section 97B.1A, subsection 8."
  1 39    #2.  Page 32, by inserting after line 34 the
  1 40 following:
  1 41    "Sec.    .  Section 602.9107, subsection 1,
  1 42 paragraph a, Code 2001, is amended to read as follows:
  1 43    a.  The annual annuity of a judge under this system
  1 44 is an amount equal to three percent of the judge's
  1 45 average annual basic salary for the judge's last
  1 46 highest three years as a judge of one or more of the
  1 47 courts included in this article, multiplied by the
  1 48 judge's years of service as a judge of one or more of
  1 49 the courts for which contributions were made to the
  1 50 system.  However, an annual annuity shall not exceed
  2  1 an amount equal to a specified percentage of the
  2  2 highest basic annual salary which the judge is
  2  3 receiving at or had received as of the time the judge
  2  4 becomes became separated from service.  Forfeitures
  2  5 shall not be used to increase the annuities a judge or
  2  6 survivor would otherwise receive under the system."
  2  7    #3.  Page 34, by inserting after line 16 the
  2  8 following:
  2  9    "Sec.    .  Section 602.9204, subsection 2,
  2 10 paragraph b, Code 2001, is amended to read as follows:
  2 11    b.  "Basic senior judge salary" means the highest
  2 12 basic annual salary which the judge is receiving at or
  2 13 had received as of the time the judge becomes became
  2 14 separated from full-time service, as would be used in
  2 15 computing an annuity pursuant to section 602.9107
  2 16 without service as a senior judge, plus seventy-five
  2 17 percent of the escalator."
