  1  1    Amend the amendment, S-5163, to Senate File 2292,
  1  2 as follows:
  1  3    #1.  Page 4, line 22 by inserting after the word
  1  4 "owner." the following:  "This section does not apply
  1  5 to any public works project that receives any funding
  1  6 from sources other than state funds."
  1  7    #2.  Page 4, line 22, by inserting after the word
  1  8 "owner." the following:  "This section does not apply
  1  9 to school districts, community colleges governed under
  1 10 chapter 260C, or board of regents institutions
  1 11 governed under chapter 262."
  1 12    #3.  Page 4, by inserting after line 22 the
  1 13 following:
  1 14    "Sec.    .  Section 73A.2, Code 2001, is amended to
  1 15 read as follows:
  1 16    73A.2  NOTICE OF HEARING.
  1 17    Before any municipality shall enter into any
  1 18 contract for any public improvement to cost twenty-
  1 19 five one hundred thousand dollars or more, the
  1 20 governing body proposing to make the contract shall
  1 21 adopt proposed plans and specifications and proposed
  1 22 form of contract, fix a time and place for hearing at
  1 23 the municipality affected or other nearby convenient
  1 24 place, and give notice by publication in at least one
  1 25 newspaper of general circulation in the municipality
  1 26 at least ten days before the hearing.
  1 27    Sec.    .  Section 262.34, unnumbered paragraph 1,
  1 28 Code 2001, is amended to read as follows:
  1 29    When the estimated cost of construction, repairs,
  1 30 or improvement of buildings or grounds under charge of
  1 31 the state board of regents exceeds twenty-five one
  1 32 hundred thousand dollars, the board shall advertise
  1 33 for bids for the contemplated improvement or
  1 34 construction and shall let the work to the lowest
  1 35 responsible bidder.  However, if in the judgment of
  1 36 the board bids received are not acceptable, the board
  1 37 may reject all bids and proceed with the construction,
  1 38 repair, or improvement by a method as the board may
  1 39 determine.  All plans and specifications for repairs
  1 40 or construction, together with bids on the plans or
  1 41 specifications, shall be filed by the board and be
  1 42 open for public inspection.  All bids submitted under
  1 43 this section shall be accompanied by a deposit of
  1 44 money, a certified check or a credit union certified
  1 45 share draft in an amount as the board may prescribe."
  1 46    #4.  Page 5, line 2, by striking the words "and
  1 47 landscape architects" and inserting the following:
  1 48 "landscape architects, and representatives of public
  1 49 owners subject to this Act".
