  1  1    Amend Senate File 2144 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  NEW SECTION.  123.49A  BREATHALYZER
  1  5 TESTS.
  1  6    An establishment that holds a class "A", class "B",
  1  7 or class "C" liquor control license shall provide a
  1  8 breathalyzer test for public use at a charge not to
  1  9 exceed three dollars per test.  A licensee shall be
  1 10 immune from liability in any civil or criminal action
  1 11 arising out of the results of a test provided pursuant
  1 12 to this section and such results shall not be
  1 13 admissible in a court of law.
  1 14    Sec. 2.  Section 307.44, Code 2001, is amended to
  1 15 read as follows:
  1 16    307.44  USE OF FEDERAL MONEYS – COOPERATION.
  1 17    1.  If funds are allotted or appropriated by the
  1 18 government of the United States for the improvement of
  1 19 transportation facilities and services in this state,
  1 20 the department may cooperate with the government of
  1 21 the United States, and any agency or department
  1 22 thereof, in the planning, acquisition, contract
  1 23 letting, construction, improvement, maintenance, and
  1 24 operation of transportation facilities and services in
  1 25 this state; may comply with the federal statutes and
  1 26 rules; and may cooperate with the federal government
  1 27 in the expenditure of the federal funds.
  1 28    In order to avoid delays, payment for the street
  1 29 and highway projects or improvements constructed in
  1 30 cooperation with the federal government may be
  1 31 advanced from the primary road fund.
  1 32    2.  If any portion of the funds allotted or
  1 33 appropriated as described in subsection 1 are
  1 34 available for public safety purposes, the department
  1 35 shall use a portion of such funds to subsidize costs
  1 36 related to the purchase, use, and maintenance of
  1 37 breathalyzer testing equipment in establishments that
  1 38 hold a class "A", class "B", or class "C" liquor
  1 39 control license pursuant to chapter 123."
  1 40    #2.  Title page, line 2, by inserting after the
  1 41 word "offenses" the following:  "and providing for
  1 42 breathalyzer tests in certain drinking
  1 43 establishments".
  1 44    #3. By renumbering as necessary.
