  1  1    Amend Senate File 2301 as follows:
  1  2    #1.  Page 2, by inserting after line 33, the
  1  3 following:
  1  4    "Sec.    .  Section 13B.8, subsection 4, Code 2001,
  1  5 is amended to read as follows:
  1  6    4.  The state public defender shall provide
  1  7 separate and suitable office space, furniture,
  1  8 equipment, computers, computer networks, support
  1  9 staff, and supplies for the each office of the local
  1 10 public defender out of funds appropriated to the
  1 11 department state public defender for this purpose.
  1 12    Sec.    .  Section 13B.8, Code 2001, is amended by
  1 13 adding the following new subsection:
  1 14    NEW SUBSECTION.  5.  An employee of a local public
  1 15 defender office shall not have access to any
  1 16 confidential client information in any other local
  1 17 public defender office, and the state public defender
  1 18 shall not have access to such confidential
  1 19 information."
  1 20    2.  Page 3, by inserting after line 13, the
  1 21 following:
  1 22    "Sec. ___.  Section 13B.9, subsection 3, Code 2001,
  1 23 is amended to read as follows:
  1 24    3.  The local public defender shall handle every
  1 25 case to which the local public defender is appointed
  1 26 if the local public defender can reasonably handle the
  1 27 case.  The local public defender shall be responsible
  1 28 for assigning cases to individual attorneys within the
  1 29 local public defender office and for making decisions
  1 30 concerning cases in which the local public defender
  1 31 has been appointed."
