  1  1    Amend Senate File 2098 as follows:
  1  2    #1.  Page 1 by inserting before line 1 the
  1  3 following:
  1  4    "Sec.    .  Section 716.1, Code 2001, is amended to
  1  5 read as follows:
  1  6    716.1  CRIMINAL MISCHIEF DEFINED.
  1  7    Any damage, defacing, alteration, or destruction of
  1  8 tangible property is criminal mischief when done
  1  9 intentionally by one who has no right to so act."
  1 10    #2.  Page 1, line 4, by inserting before the words
  1 11 "A person" the following:  "1.".
  1 12    #3.  Page 1, line 7, by striking the figure "1" and
  1 13 inserting the following:  "a".
  1 14    #4.  Page 1, line 10, by inserting after the figure
  1 15 "476.1," the following:  "operational or support data
  1 16 of a public airport,".
  1 17    #5.  Page 1, line 12, by striking the figure "2"
  1 18 and inserting the following:  "b".
  1 19    #6.  Page 1, line 14, by striking the figure "3"
  1 20 and inserting the following:  "c".
  1 21    #7.  Page 1, by inserting after line 15 the
  1 22 following:
  1 23    "2.  The prosecuting attorney may institute civil
  1 24 proceedings against any person in district court
  1 25 seeking relief from conduct constituting a violation
  1 26 of this section or to prevent, restrain, or remedy
  1 27 such a violation."
  1 28    #8.  Title page, line 1, by striking the word
  1 29 "offense" and inserting the following:  "offenses".
  1 30    #9.  Title page, line 2, by inserting after the
  1 31 word "access" the following:  "and criminal mischief".
