  1  4 RELATING TO THE CRIMINAL OFFENSES OF UNAUTHORIZED COMPUTER
  1  5    ACCESS AND CRIMINAL MISCHIEF, AND PROVIDING A PENALTY.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 716.1, Code 2001, is amended to read as
  1 10 follows:
  1 11    716.1  CRIMINAL MISCHIEF DEFINED.
  1 12    Any damage, defacing, alteration, or destruction of
  1 13 tangible property is criminal mischief when done intentionally
  1 14 by one who has no right to so act.
  1 15    Sec. 2.  Section 716.6B, Code 2001, is amended to read as
  1 16 follows:
  1 17    716.6B  UNAUTHORIZED COMPUTER ACCESS.
  1 18    1.  A person who knowingly and without authorization
  1 19 accesses a computer, computer system, or computer network
  1 20 commits a simple misdemeanor the following:
  1 21    a.  An aggravated misdemeanor if computer data is accessed
  1 22 that contains a confidential record, as defined in section
  1 23 22.7, operational or support data of a public utility, as
  1 24 defined in section 476.1, operational or support data of a
  1 25 public airport, or a trade secret, as defined in section
  1 26 550.2.
  1 27    b.  A serious misdemeanor if computer data is copied,
  1 28 altered, or deleted.
  1 29    c.  A simple misdemeanor for any access which is not an
  1 30 aggravated or serious misdemeanor.
  1 31    2.  The prosecuting attorney or an aggrieved person may
  1 32 institute civil proceedings against any person in district
  1 33 court seeking relief from conduct constituting a violation of
  1 34 this section or to prevent, restrain, or remedy such a
  1 35 violation.
