  1  1    Amend House File 755, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 28, by inserting after line 19, the
  1  4 following:  
  1  5                      "DIVISION ___
  1  6    Sec.    .  NEW SECTION.  231.61  SENIOR
  1  7 PHARMACEUTICAL ASSISTANCE PROGRAM ESTABLISHED.
  1  8    1.  For the purposes of this section, unless the
  1  9 context otherwise requires:
  1 10    a.  "Eligible person" means a person, sixty-five
  1 11 years of age or older, with an annual net income of
  1 12 not more than two hundred fifty percent of the federal
  1 13 poverty level, as defined by the most recent poverty
  1 14 income guidelines published by the United States
  1 15 department of health and human services; or a person,
  1 16 sixty-five years of age or older, who with the
  1 17 person's spouse has an annual net income of not more
  1 18 than two hundred fifty percent of the federal poverty
  1 19 level, as defined by the most recent poverty income
  1 20 guidelines published by the United States department
  1 21 of health and human services.  "Eligible person" does
  1 22 not include a person who is eligible for financial
  1 23 assistance for the purchase of prescription drugs
  1 24 under another local, state, or federal program to the
  1 25 extent that the other program provides financial
  1 26 assistance for the purchase of prescription drugs.
  1 27    b.  "Prescription drug" means a prescription drug
  1 28 as defined in section 155A.3.
  1 29    c.  "Program" means the senior pharmaceutical
  1 30 assistance program established in this section.
  1 31    2.  A senior pharmaceutical assistance program is
  1 32 established within the department to provide for
  1 33 subsidization of the prescription drug costs of
  1 34 eligible persons.  The program shall be administered
  1 35 through the area agencies on aging.
  1 36    3.  The commission shall adopt rules to implement
  1 37 this section.  The rules shall provide for all of the
  1 38 following:
  1 39    a.  A means to determine the eligibility of a
  1 40 person, including proof of the person's actual and
  1 41 anticipated annual net income, evidence of complete or
  1 42 partial payment for the costs of prescription drugs
  1 43 from a provider other than the program, and other
  1 44 provisions consistent with this section.
  1 45    b.  The program application form.  An initial
  1 46 application shall be accompanied by proof of the date
  1 47 of birth of the person.
  1 48    c.  Issuance by the department of a participation
  1 49 card, upon approval of an application.  The card shall
  1 50 act as a form of identification for a person to use in
  2  1 proving eligibility.
  2  2    d.  Prescription copayment and deductible amount.
  2  3    e.  Pharmacist case management.
  2  4    4.  In establishing copayment and deductible
  2  5 amounts, the goal of the commission shall be to
  2  6 provide a benefit to the greatest number of eligible
  2  7 persons.  The department may negotiate group discounts
  2  8 or utilize other methods to reduce the cost of
  2  9 prescription drugs provided under the program.
  2 10    5.  The department shall establish a pharmaceutical
  2 11 assistance education program to provide information
  2 12 regarding options for pharmaceutical assistance.  The
  2 13 pharmaceutical assistance education program shall be
  2 14 provided through the area agencies on aging.
  2 15    Sec.    .  APPROPRIATION.  There is appropriated
  2 16 from the general fund of the state to the department
  2 17 of elder affairs for the fiscal year beginning July 1,
  2 18 2001, and ending June 30, 2002, the following amount,
  2 19 or so much thereof as is necessary, for the purpose
  2 20 designated:
  2 21    For the senior pharmaceutical assistance program
  2 22 and the pharmaceutical assistance education program
  2 23 established pursuant to section 231.61:  
  2 24 .................................................. $  5,000,000"
