  1  1    Amend House File 746, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 12, by striking lines 8 through 21, and
  1  4 inserting the following:
  1  5    "Sec.    .  STATE EMPLOYEE BENEFIT PROGRAMS –
  1  6 ADMINISTRATIVE COSTS.
  1  7    1.  For the fiscal year beginning July 1, 2001, and
  1  8 ending June 30, 2002, the department of personnel
  1  9 shall include a monthly administration charge of $2.00
  1 10 per contract on all health insurance plans
  1 11 administered by the department.  This is an
  1 12 administration fee attributable only to the employer
  1 13 share for those employees who are eligible for the
  1 14 state share of insurance.  If the contract holder is
  1 15 without a state employer to pay the fee, the contract
  1 16 holder shall not be assessed the fee of $2.00 per
  1 17 month.
  1 18    2.  For the fiscal year beginning July 1, 2001, and
  1 19 ending June 30, 2002, the state board of regents, all
  1 20 regional libraries, the state fair board, the
  1 21 department of transportation, and the eight judicial
  1 22 district departments of correctional services shall
  1 23 report and remit the administration charge on a
  1 24 monthly basis to the department of revenue and
  1 25 finance.  The report shall contain the number and type
  1 26 of health insurance contracts held by each of its
  1 27 employees whose health insurance is administered by
  1 28 the department of personnel.
  1 29    3.  A health insurance administration fund is
  1 30 created in the state treasury.  The proceeds of the
  1 31 monthly administration charge shall be remitted to the
  1 32 health insurance administration fund.  The department
  1 33 of revenue and finance shall collect from each
  1 34 department on centralized payroll the administration
  1 35 charge each month and shall remit the amount to the
  1 36 health insurance administration fund.  The department
  1 37 of personnel may expend no more than $600,000 from the
  1 38 health insurance administration fund for the fiscal
  1 39 year beginning July 1, 2001, and ending June 30, 2002.
  1 40 Any unencumbered or unobligated balance in the health
  1 41 insurance administration fund at the end of the fiscal
  1 42 year shall be transferred to the health insurance
  1 43 surplus fund."
  1 44    #2.  Page 12, by inserting before line 22, the
  1 45 following:
  1 46    "Sec.    .  Section 80.8, unnumbered paragraphs 2
  1 47 and 3, Code 2001, are amended to read as follows:
  1 48    The commissioner may delegate to the members of the
  1 49 Iowa state patrol peace officers of the department
  1 50 such additional duties in the enforcement of this
  2  1 chapter as the commissioner may deem proper and
  2  2 incidental to the duties now imposed upon them by law.
  2  3    The salaries of all members and employees of the
  2  4 department and the expenses of the department shall be
  2  5 provided for by the legislative appropriation
  2  6 therefor.  The compensation of the members of the Iowa
  2  7 state patrol peace officers of the department shall be
  2  8 fixed according to grades as to rank and length of
  2  9 service by the commissioner with the approval of the
  2 10 governor.  The members of the Iowa state patrol peace
  2 11 officers shall be paid additional compensation in
  2 12 accordance with the following formula:  When members
  2 13 of the Iowa state patrol peace officers have served
  2 14 for a period of five years their compensation then
  2 15 being paid shall be increased by the sum of twenty-
  2 16 five dollars per month beginning with the month
  2 17 succeeding the foregoing described five-year period;
  2 18 when members thereof peace officers have served for a
  2 19 period of ten years their compensation then being paid
  2 20 shall be increased by the sum of twenty-five dollars
  2 21 per month beginning with the month succeeding the
  2 22 foregoing described ten-year period, such sums being
  2 23 in addition to the increase provided herein to be paid
  2 24 after five years of service; when members thereof
  2 25 peace officers have served for a period of fifteen
  2 26 years their compensation then being paid shall be
  2 27 increased by the sum of twenty-five dollars per month
  2 28 beginning with the month succeeding the foregoing
  2 29 described fifteen-year period, such sums being in
  2 30 addition to the increases previously provided for
  2 31 herein; when members thereof peace officers have
  2 32 served for a period of twenty years their compensation
  2 33 then being paid shall be increased by the sum of
  2 34 twenty-five dollars per month beginning with the month
  2 35 succeeding the foregoing described twenty-year period,
  2 36 such sums being in addition to the increases
  2 37 previously provided for herein.  While on active duty
  2 38 each member peace officer shall also receive a flat
  2 39 daily sum as fixed by the commissioner with the
  2 40 approval of the governor for meals while away from the
  2 41 office to which the member has been assigned and
  2 42 within the member's district."
  2 43    #3.  By striking page 12, line 22, through page 13,
  2 44 line 8, and inserting the following:
  2 45    "Sec. ___.  TERMINAL LIABILITY HEALTH INSURANCE
  2 46 SURCHARGE.  For the fiscal year beginning July 1,
  2 47 2001, and ending June 30, 2002, the department of
  2 48 personnel shall include in the rates for the Wellmark
  2 49 Blue Cross/Blue Shield Program 3 Plus, Wellmark Blue
  2 50 Cross/Blue Shield Program 3 plus with a comprehensive
  3  1 major medical overlay, and Iowa Select Preferred
  3  2 Provider Organization health insurance plans a
  3  3 surcharge, as determined by the department of
  3  4 management, on only the employer's share of the health
  3  5 insurance premium cost to fund the state's share of
  3  6 the terminal liability of the existing Wellmark health
  3  7 insurance contract.  The department of revenue and
  3  8 finance shall collect the surcharge from state
  3  9 agencies, the state fair board, state board of
  3 10 regents, and the eight judicial district departments
  3 11 of correctional services.  The proceeds of the
  3 12 surcharge shall be credited to the terminal liability
  3 13 insurance fund.  The health insurance plans provided
  3 14 to state employees covered by the state police
  3 15 officers council collective bargaining agreement are
  3 16 exempt from the surcharge provided in this section.
  3 17    Sec. ___.  NEW SECTION.  421.46  TERMINAL LIABILITY
  3 18 HEALTH INSURANCE FUND.
  3 19    1.  A terminal liability health insurance fund is
  3 20 created in the state treasury under the control of the
  3 21 department of personnel.  The proceeds of the terminal
  3 22 liability health insurance fund shall be used by the
  3 23 department of personnel to pay the state's share of
  3 24 the terminal liability of the existing health
  3 25 insurance contract administered by the department of
  3 26 personnel.  The moneys appropriated to the terminal
  3 27 liability health insurance fund plus any additional
  3 28 moneys appropriated or collected pursuant to this Act
  3 29 or other Acts of the general assembly shall constitute
  3 30 the total amount due to pay the terminal liability
  3 31 specified in this section.
  3 32    2.  The proceeds of the terminal liability health
  3 33 insurance fund shall also be used by the department of
  3 34 revenue and finance to reimburse state agencies for
  3 35 expenditures related to the payment of the health
  3 36 insurance plans surcharge for the terminal liability
  3 37 of the health insurance contract for state employees.
  3 38 The department of revenue and finance shall provide
  3 39 guidelines and forms for documentation that a state
  3 40 agency shall submit for the health insurance
  3 41 reimbursement.  The reimbursement shall be restricted
  3 42 to the amount of moneys appropriated from the general
  3 43 fund of the state that is used to pay the terminal
  3 44 liability of health insurance for state employees for
  3 45 the fiscal year.
  3 46    3.  Notwithstanding section 8.33, any unencumbered
  3 47 or unobligated balance remaining in the terminal
  3 48 liability health insurance fund at the close of a
  3 49 fiscal year shall not revert.  However, upon total
  3 50 payment of the terminal liability of the existing
  4  1 health insurance contract administered by the
  4  2 department of personnel, any remaining balance in the
  4  3 terminal liability health insurance fund shall revert
  4  4 to the credit of the unassigned revenue fund
  4  5 administered by the Iowa comprehensive underground
  4  6 storage tank fund board."
