  1  1    Amend Senate File 350, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 8 the
  1  4 following:
  1  5    "Sec.    .  Section 321.20A, Code 2001, is amended
  1  6 to read as follows:
  1  7    321.20A  CERTIFICATE OF TITLE – COMMERCIAL
  1  8 VEHICLES.
  1  9    1.  Notwithstanding other provisions of this
  1 10 chapter, the owner of a commercial vehicle subject to
  1 11 the proportional registration provisions of chapter
  1 12 326 may make application to the department or the
  1 13 appropriate county treasurer for a certificate of
  1 14 title.  The application for certificate of title shall
  1 15 be made within thirty days of purchase or transfer and
  1 16 shall be accompanied by a ten dollar title fee and the
  1 17 appropriate use tax.  The department or the county
  1 18 treasurer shall deliver the certificate of title to
  1 19 the owner if no security interest or encumbrance
  1 20 appears on the certificate or to the person holding
  1 21 the first security interest or encumbrance shown on
  1 22 the certificate of title.
  1 23    2.  A commercial vehicle An owner of a commercial
  1 24 vehicle subject to the proportional registration
  1 25 provisions of chapter 326 who has a fleet of more than
  1 26 fifty commercial vehicles and who is issued a
  1 27 certificate of title under this section shall not be
  1 28 subject to registration fees until the commercial
  1 29 vehicle is driven or moved upon the highways.  The
  1 30 registration fee due shall be prorated for the
  1 31 remaining unexpired months of the registration year.
  1 32 Ownership of the commercial vehicle shall not be
  1 33 transferred until registration fees have been paid to
  1 34 the department.
  1 35    3.  This section shall apply to owners with fleets
  1 36 of more than fifty commercial vehicles based in Iowa
  1 37 under the proportional registration provisions of
  1 38 chapter 326.  The original certificate of title shall
  1 39 be delivered to the owner if no security interest or
  1 40 encumbrance appears on the certificate; otherwise, the
  1 41 certificate of title shall be delivered by the
  1 42 department to the person holding the first security
  1 43 interest or encumbrance as shown on the certificate of
  1 44 title."
  1 45    #2.  Page 1, by inserting after line 35 the
  1 46 following:
  1 47    "Sec. 101.  Section 321.113, Code 2001, is amended
  1 48 to read as follows:
  1 49    321.113  AUTOMATIC REDUCTION.
  1 50    1.  The registration fee for a motor vehicle shall
  2  1 not be automatically reduced under this section unless
  2  2 the registration fee is based on the value and weight
  2  3 of the motor vehicle as provided in section 321.109,
  2  4 subsection 1.
  2  5    2.  After If a motor vehicle is more than five
  2  6 model years old, that the part of the registration fee
  2  7 which that is based on the value of the vehicle shall
  2  8 be:
  2  9    Seventy-five seventy-five percent of the rate as
  2 10 fixed when the motor vehicle was new;.
  2 11    3.  After If a motor vehicle is more than six model
  2 12 years old, the part of the registration fee that is
  2 13 based on the value of the vehicle shall be fifty
  2 14 percent; of the rate as fixed when the motor vehicle
  2 15 was new.
  2 16    After a motor vehicle is more than eight model
  2 17 years old, that part of the registration fee based on
  2 18 the value of the vehicle shall be ten percent.  Where
  2 19 the ninth registration fee for a motor vehicle has
  2 20 been computed and fixed by the department prior to
  2 21 July 4, 1949, there shall be added to the registration
  2 22 fee, in lieu of the ten percent provided for herein,
  2 23 one dollar if such registration fee has been computed
  2 24 and fixed at fifteen dollars or less and two dollars
  2 25 if the registration fee has been computed and fixed at
  2 26 more than fifteen dollars.
  2 27    4.  If a 1994 model year or newer motor vehicle is
  2 28 nine model years old or older the registration fee is
  2 29 thirty-five dollars.  For purposes of determining the
  2 30 portion of the registration fee under this subsection
  2 31 that is based upon the value of the motor vehicle,
  2 32 sixty percent of the registration fee is attributable
  2 33 to the value of the vehicle.
  2 34    5.  a.  If a 1993 model year or older motor vehicle
  2 35 has been titled in the same person's name since the
  2 36 vehicle was new or the title to the vehicle was
  2 37 transferred prior to January 1, 2002, the part of the
  2 38 registration fee that is based on the value of the
  2 39 vehicle shall be ten percent of the rate as fixed when
  2 40 the motor vehicle was new.
  2 41    b.  If the title of a 1993 or older motor vehicle
  2 42 is transferred to a new owner or if such a motor
  2 43 vehicle is brought into the state on or after January
  2 44 1, 2002, the registration fee shall not be based on
  2 45 the weight and list price of the motor vehicle, but
  2 46 shall be as follows:  
  2 47    (1)  For a motor vehicle that is model year 1969
  2 48 or older:
  2 49 .................................................. $      16.00
  2 50    (2)  For a motor vehicle that is model year 1970
  3  1 through 1989:
  3  2 .................................................. $      23.00
  3  3    (3)  For a motor vehicle that is model year 1990
  3  4 through 1993:
  3  5 .................................................. $      27.00
  3  6    For purposes of determining the portion of the
  3  7 registration fee under this paragraph "b" that is
  3  8 based upon the value of the motor vehicle, sixty
  3  9 percent of the registration fee is attributable to the
  3 10 value of the value."
  3 11    #3.  Page 9, by inserting after line 31 the
  3 12 following:
  3 13    "Sec. 102.  Section 422.9, subsection 2, paragraph
  3 14 g, Code 2001, is amended by striking the paragraph and
  3 15 inserting in lieu thereof:
  3 16    g.  To the extent not otherwise included pursuant
  3 17 to section 164 of the Internal Revenue Code, add the
  3 18 amount of the annual registration fee paid for a motor
  3 19 vehicle pursuant to section 321.113, subsection 4, or
  3 20 section 321.113, subsection 5, paragraph "b", which is
  3 21 based upon the value of the vehicle.  For purposes of
  3 22 this paragraph, sixty percent of the amount of the
  3 23 registration fee is based upon the value of the motor
  3 24 vehicle."
  3 25    #4.  Page 9, by inserting after line 32 the
  3 26 following:
  3 27    "Sec.    .  EFFECTIVE DATE.  Sections 101 and 102
  3 28 of this Act, amending sections 321.113 and 422.9, take
  3 29 effect January 1, 2002."
  3 30    #5.  Title page, line 3, by inserting after the
  3 31 word "permits," the following:  "commercial vehicle
  3 32 certificates of title,".
  3 33    #6.  Title page, line 3, by inserting after the
  3 34 word "permits," the following:  "flat registration
  3 35 fees for older vehicles,".
  3 36    #7.  Title page, line 6, by inserting after the
  3 37 word "transport" the following:  ", and providing an
  3 38 effective date".
  3 39    #8.  By renumbering, relettering, or redesignating
  3 40 and correcting internal references as necessary.
