1 5 " . "Biotechnological system or technique" means
1 6 a process used to alter the genetic characteristics of
1 7 a plant by modifying the deoxyribonucleic acid of the
1 8 plant's seed in a manner other than by breeding or
1 9 pollination."
1 10 #2. Page 4, by striking line 19, and inserting the
1 11 following:
1 12 "1. A person shall not".
1 13 #3. Page 4, line 22, by inserting after the words
1 14 "crop operation property" the following: ", without
1 15 the consent of the owner".
1 16 #4. Page 4, line 25, by inserting after the word
1 17 "property" the following: ", without the consent of
1 18 the owner".
1 19 #5. Page 4, line 26, by inserting after the word
1 20 "property," the following: "without the consent of
1 21 the owner,".
1 22 #6. Page 5, by inserting after line 12, the
1 23 following:
1 24 "d. Blend grain from a crop originating from an
1 25 agricultural seed as defined in section 199.1 that has
1 26 been genetically modified using a biotechnological
1 27 system or technique with grain from a crop originating
1 28 from an agricultural seed that has not been so
1 29 genetically modified, unless the person provides a
1 30 disclosure to a purchaser of the grain. The
1 31 disclosure statement shall notify the purchaser that
1 32 the grain is blended with grain from a crop
1 33 originating from agricultural seed that has been
1 34 genetically modified as provided in this paragraph.
1 35 The same disclosure statement shall be provided by a
1 36 purchaser to each subsequent purchaser. The
1 37 disclosure statement shall be in writing and provide
1 38 the notice as required by rules adopted by the
1 39 department of agriculture and land stewardship."
1 40 #7. Page 6, by inserting after line 30, the
1 41 following:
1 42 "4A. A person who blends grain that includes grain
1 43 from a crop originating from an agricultural seed that
1 44 has been genetically modified or who sells such
1 45 blended grain in violation of subsection 1, paragraph
1 46 "d", is guilty of a serious misdemeanor."
1 47 #8. By renumbering as necessary.
