  1  1    Amend Senate File 100 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  Section 125.12, Code 2001, is amended
  1  5 by adding the following new subsection:
  1  6    NEW SUBSECTION.  8.  a.  The department shall
  1  7 develop a risk assessment profile instrument for use
  1  8 by health care providers as defined in section 135.61
  1  9 to screen pregnant women for the presence of prenatal
  1 10 substance abuse.
  1 11    b.  A health care provider who identifies a
  1 12 pregnant woman as being at risk for prenatal substance
  1 13 abuse may, with the woman's consent, refer the woman
  1 14 to the department for service coordination.  The
  1 15 referral shall be made by providing the woman's name
  1 16 to the department within five working days of the date
  1 17 of identification.  A woman's consent shall be deemed
  1 18 to be a waiver of the privilege attaching to
  1 19 confidential communications between a health care
  1 20 provider and patient.
  1 21    c.  A civil or criminal cause of action shall not
  1 22 be made against a health care provider relating to the
  1 23 provider's rendering of or failure to render
  1 24 assessment and referral or other service under this
  1 25 subsection.  A referral made under this subsection and
  1 26 any documentation associated with the referral shall
  1 27 not be used in any criminal prosecution.  Any record
  1 28 or report regarding the pregnant woman shall be kept
  1 29 confidential by the person making the record or
  1 30 report.
  1 31    d.  A pregnant woman referred to the department
  1 32 under this subsection shall be deemed to be a first
  1 33 priority user of substance abuse treatment services
  1 34 available through the department.  The department
  1 35 shall ensure that family-oriented substance abuse
  1 36 treatment services are available to meet the needs of
  1 37 such pregnant women.
  1 38    e.  The department of human services shall
  1 39 coordinate with the Iowa department of public health
  1 40 as necessary to provide for the temporary placement of
  1 41 the children of a pregnant woman who is receiving
  1 42 treatment services pursuant to a referral made under
  1 43 this subsection.
  1 44    f.  A substance abuse treatment services provider
  1 45 that is receiving public funding shall not refuse to
  1 46 provide treatment to a woman solely because the woman
  1 47 is pregnant."
  1 48    #2.  Title page, by striking line 2 and inserting
  1 49 the following:  "for referral and treatment services."
  1 50    #3.  By renumbering as necessary.
