PAG LIN 1 1 Amend Senate File 65 as follows: 1 2 #1. Page 1, by striking lines 1 through 29. 1 3 #2. By striking page 2, line 10 through page 3, 1 4 line 23 and inserting the following: 1 5 "Sec. . Section 476.6, Code 2001, is amended by 1 6 adding the following new subsection: 1 7 NEW SUBSECTION. 25. LOW-INCOME FUNDING. Moneys 1 8 collected by rate-regulated gas utilities pursuant to 1 9 subsection 19, paragraph "e", that represent 1 10 unrecovered amounts for the gas portions of energy 1 11 efficiency plans approved prior to July 1, 1996, shall 1 12 be paid, up to a maximum of fifteen million dollars 1 13 for the fiscal year beginning July 1, 2000, and up to 1 14 a maximum of twenty million dollars for the fiscal 1 15 year beginning July 1, 2001, to the department of 1 16 human rights. The moneys received by the department 1 17 are appropriated to the department and shall be used 1 18 to provide financial assistance to eligible low-income 1 19 customers of gas public utilities, as defined by the 1 20 federal low-income home heating energy assistance 1 21 program guidelines, in paying their natural gas bills. 1 22 The board shall adopt rules specifying each rate- 1 23 regulated gas utility's share of the fund and each 1 24 utility's allocation methods among residential and 1 25 other firm customers, but a customer's rates shall not 1 26 increase as a result of this subsection. These funds 1 27 shall be paid to the department for the period 1 28 beginning on the effective date of this subsection and 1 29 ending six hundred thirty days later, after which time 1 30 rate-regulated gas utilities may continue recovery of 1 31 any remaining amounts for the gas portions of energy 1 32 efficiency plans approved prior to July 1, 1996. 1 33 The board may direct, upon the department of human 1 34 rights' request, all rate-regulated gas utilities to 1 35 advance to the department a maximum of the authorized 1 36 amount collected and paid to the department under this 1 37 subsection for each specified fiscal year, pursuant to 1 38 the allocation methods adopted by the board, to allow 1 39 for the provision of immediate financial assistance to 1 40 eligible customers. A rate-regulated gas utility 1 41 advancing moneys shall have the amount of the advance 1 42 added to the unpaid amount of the gas portion of its 1 43 energy efficiency plan approved prior to July 1, 1996, 1 44 and interest shall be paid on any moneys advanced at a 1 45 rate equal to the interest paid on the unrecovered gas 1 46 portions of energy efficiency plans approved prior to 1 47 July 1, 1996." 1 48 #3.
