PAG LIN 1 1 Section 1. SUBSTANCE ABUSE APPROPRIATION. 1 2 1. There is appropriated from the fund created by section 1 3 8.41 to the Iowa department of public health for the federal 1 4 fiscal year beginning October 1, 2002, and ending September 1 5 30, 2003, the following amount: 1 6 .................................................. $ 12,698,390 1 7 a. Funds appropriated in this subsection are the 1 8 anticipated funds to be received from the federal government 1 9 for the designated federal fiscal year under 42 U.S.C., 1 10 chapter 6A, subchapter XVII, which provides for the substance 1 11 abuse prevention and treatment block grant. The department 1 12 shall expend the funds appropriated in this subsection as 1 13 provided in the federal law making the funds available and in 1 14 conformance with chapter 17A. 1 15 b. Of the funds appropriated in this subsection, an amount 1 16 not exceeding 5 percent shall be used by the department for 1 17 administrative expenses. 1 18 c. The department shall expend no less than an amount 1 19 equal to the amount expended for treatment services in the 1 20 state fiscal year beginning July 1, 2001, for pregnant women 1 21 and women with dependent children. 1 22 d. Of the funds appropriated in this subsection, an amount 1 23 not exceeding $24,585 shall be used for audits. 1 24 2. The funds remaining from the appropriation made in 1 25 subsection 1 shall be allocated as follows: 1 26 a. At least 20 percent of the allocation shall be for 1 27 prevention programs. 1 28 b. At least 35 percent of the allocation shall be spent on 1 29 drug treatment and prevention activities. 1 30 c. At least 35 percent of the allocation shall be spent on 1 31 alcohol treatment and prevention activities. 1 32 3. The substance abuse block grant funds received from the 1 33 federal government in excess of the amount of the anticipated 1 34 federal fiscal year 2002-2003 award appropriated in subsection 1 35 1 shall be distributed at least 50 percent to treatment 2 1 programs and 50 percent to prevention programs except that, 2 2 based upon federal guidelines, the total amount of the excess 2 3 awarded to prevention programs shall not exceed $1,000,000. 2 4 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION. 2 5 1. a. There is appropriated from the fund created by 2 6 section 8.41 to the Iowa department of human services for the 2 7 federal fiscal year beginning October 1, 2002, and ending 2 8 September 30, 2003, the following amount: 2 9 .................................................. $ 3,587,827 2 10 b. Funds appropriated in this subsection are the 2 11 anticipated funds to be received from the federal government 2 12 for the designated federal fiscal year under 42 U.S.C., 2 13 chapter 6A, subchapter XVII, which provides for the community 2 14 mental health services block grant. The department shall 2 15 expend the funds appropriated in this subsection as provided 2 16 in the federal law making the funds available and in 2 17 conformance with chapter 17A. 2 18 c. The administrator of the division of mental health and 2 19 developmental disabilities of the department of human services 2 20 shall allocate not less than 95 percent of the amount of the 2 21 block grant to eligible community mental health services 2 22 providers for carrying out the plan submitted to and approved 2 23 by the federal substance abuse and mental health services 2 24 administration for the fiscal year involved. 2 25 2. An amount not exceeding 5 percent of the funds 2 26 appropriated in subsection 1 shall be used by the department 2 27 of human services for administrative expenses. From the funds 2 28 set aside by this subsection for administrative expenses, the 2 29 division of mental health and developmental disabilities shall 2 30 pay to the auditor of state an amount sufficient to pay the 2 31 cost of auditing the use and administration of the state's 2 32 portion of the funds appropriated in subsection 1. The 2 33 auditor of state shall bill the division of mental health and 2 34 developmental disabilities for the costs of the audits. 2 35 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS. 3 1 1. There is appropriated from the fund created by section 3 2 8.41 to the Iowa department of public health for the federal 3 3 fiscal year beginning October 1, 2002, and ending September 3 4 30, 2003, the following amount: 3 5 .................................................. $ 7,016,116 3 6 The funds appropriated in this subsection are the funds 3 7 anticipated to be received from the federal government for the 3 8 designated federal fiscal year under 42 U.S.C., chapter 7, 3 9 subchapter V, which provides for the maternal and child health 3 10 services block grant. The department shall expend the funds 3 11 appropriated in this subsection as provided in the federal law 3 12 making the funds available and in conformance with chapter 3 13 17A. 3 14 Of the funds appropriated in this subsection, an amount not 3 15 exceeding $45,700 shall be used for audits. 3 16 Funds appropriated in this subsection shall not be used by 3 17 the university of Iowa hospitals and clinics for indirect 3 18 costs. 3 19 2. An amount not exceeding $150,000 of the funds 3 20 appropriated in subsection 1 to the Iowa department of public 3 21 health shall be used by the Iowa department of public health 3 22 for administrative expenses in addition to the amount to be 3 23 used for audits in subsection 1. 3 24 The departments of public health, human services, and 3 25 education and the university of Iowa's mobile and regional 3 26 child health specialty clinics shall continue to pursue to the 3 27 maximum extent feasible the coordination and integration of 3 28 services to women and children. 3 29 3. a. Sixty-three percent of the remaining funds 3 30 appropriated in subsection 1 shall be allocated to supplement 3 31 appropriations for maternal and child health programs within 3 32 the Iowa department of public health. Of these funds, 3 33 $284,548 shall be set aside for the statewide perinatal care 3 34 program. 3 35 b. Thirty-seven percent of the remaining funds 4 1 appropriated in subsection 1 shall be allocated to the 4 2 university of Iowa hospitals and clinics under the control of 4 3 the state board of regents for mobile and regional child 4 4 health specialty clinics. The university of Iowa hospitals 4 5 and clinics shall not receive an allocation for indirect costs 4 6 from the funds for this program. Priority shall be given to 4 7 establishment and maintenance of a statewide system of mobile 4 8 and regional child health specialty clinics. 4 9 4. The Iowa department of public health shall administer 4 10 the statewide maternal and child health program and the 4 11 crippled children's program by conducting mobile and regional 4 12 child health specialty clinics and conducting other activities 4 13 to improve the health of low-income women and children and to 4 14 promote the welfare of children with actual or potential 4 15 handicapping conditions and chronic illnesses in accordance 4 16 with the requirements of Title V of the federal Social 4 17 Security Act. 4 18 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES 4 19 APPROPRIATIONS. 4 20 1. There is appropriated from the fund created by section 4 21 8.41 to the Iowa department of public health for the federal 4 22 fiscal year beginning October 1, 2002, and ending September 4 23 30, 2003, the following amount: 4 24 .................................................. $ 1,934,758 4 25 Funds appropriated in this subsection are the funds 4 26 anticipated to be received from the federal government for the 4 27 designated federal fiscal year under 42 U.S.C., chapter 6A, 4 28 subchapter XVII, which provides for the preventive health and 4 29 health services block grant. The department shall expend the 4 30 funds appropriated in this subsection as provided in the 4 31 federal law making the funds available and in conformance with 4 32 chapter 17A. 4 33 Of the funds appropriated in this subsection, an amount not 4 34 exceeding $5,522 shall be used for audits. 4 35 2. Of the funds appropriated in subsection 1, the specific 5 1 amount of funds stipulated by the notice of the block grant 5 2 award shall be allocated for services to victims of sex 5 3 offenses and for rape prevention education. 5 4 3. After deducting the funds allocated in subsections 1 5 5 and 2, an amount not exceeding $94,670 of the remaining funds 5 6 appropriated in subsection 1 shall be used by the Iowa 5 7 department of public health for administrative expenses in 5 8 addition to the amount to be used for audits in subsection 1. 5 9 4. After deducting the funds allocated in subsections 1, 5 10 2, and 3, the remaining funds appropriated in subsection 1 5 11 shall be used by the department for healthy people 5 12 2010/healthy Iowans 2010 program objectives, preventive health 5 13 advisory committee, and risk reduction services, including 5 14 nutrition programs, health incentive programs, chronic disease 5 15 services, emergency medical services, monitoring of the 5 16 fluoridation program and start-up fluoridation grants, and 5 17 acquired immune deficiency syndrome services. The moneys 5 18 specified in this subsection shall not be used by the 5 19 university of Iowa hospitals and clinics or by the state 5 20 hygienic laboratory for the funding of indirect costs. Of the 5 21 funds used by the department under this subsection, an amount 5 22 not exceeding $90,000 shall be used for the monitoring of the 5 23 fluoridation program and for start-up fluoridation grants to 5 24 public water systems, and an amount not exceeding $50,000 5 25 shall be used to provide chlamydia testing. 5 26 Sec. 5. DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM 5 27 APPROPRIATION. 5 28 1. There is appropriated from the fund created in section 5 29 8.41 to the office of the governor for the drug policy 5 30 coordinator for the federal fiscal year beginning October 1, 5 31 2002, and ending September 30, 2003, the following amount: 5 32 .................................................. $ 6,473,528 5 33 Funds appropriated in this subsection are the anticipated 5 34 funds to be received from the federal government for the 5 35 designated fiscal year under 42 U.S.C., chapter 46, subchapter 6 1 V, which provides for the drug control and system improvement 6 2 grant program. The drug policy coordinator shall expend the 6 3 funds appropriated in this subsection as provided in the 6 4 federal law making the funds available and in conformance with 6 5 chapter 17A. 6 6 2. An amount not exceeding 10 percent of the funds 6 7 appropriated in subsection 1 shall be used by the drug policy 6 8 coordinator for administrative expenses. From the funds set 6 9 aside by this subsection for administrative expenses, the drug 6 10 policy coordinator shall pay to the auditor of state an amount 6 11 sufficient to pay the cost of auditing the use and 6 12 administration of the state's portion of the funds 6 13 appropriated in subsection 1. 6 14 Sec. 6. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM 6 15 APPROPRIATION. 6 16 1. There is appropriated from the fund created in section 6 17 8.41 to the office of the governor for the drug policy 6 18 coordinator for the federal fiscal year beginning October 1, 6 19 2002, and ending September 30, 2003, the following amount: 6 20 .................................................. $ 1,811,502 6 21 Funds appropriated in this subsection are the anticipated 6 22 funds to be received from the federal government for the 6 23 designated fiscal year under 42 U.S.C., chapter 46, subchapter 6 24 XII-H, which provides for grants to combat violent crimes 6 25 against women. The drug policy coordinator shall expend the 6 26 funds appropriated in this subsection as provided in the 6 27 federal law making the funds available and in conformance with 6 28 chapter 17A. 6 29 2. An amount not exceeding 5 percent of the funds 6 30 appropriated in subsection 1 shall be used by the drug policy 6 31 coordinator for administrative expenses. From the funds set 6 32 aside by this subsection for administrative expenses, the drug 6 33 policy coordinator shall pay to the auditor of the state an 6 34 amount sufficient to pay the cost of auditing the use and 6 35 administration of the state's portion of the funds 7 1 appropriated in subsection 1. 7 2 3. If an enactment of the Seventy-ninth General Assembly, 7 3 2002 Session, transfers responsibility for the stop violence 7 4 against women grant program to the department of justice, the 7 5 appropriation made in this section shall be made to the 7 6 department of justice in lieu of the office of the governor. 7 7 Sec. 7. LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION. 7 8 1. There is appropriated from the fund created in section 7 9 8.41 to the office of the governor for the drug policy 7 10 coordinator for the federal fiscal year beginning October 1, 7 11 2002, and ending September 30, 2003, the following amount: 7 12 .................................................. $ 341,733 7 13 Funds appropriated in this subsection are the funds 7 14 anticipated to be received from the federal government for the 7 15 designated federal fiscal year under annual federal 7 16 appropriations which provide for grants to reduce crime and 7 17 improve public safety. The drug policy coordinator shall 7 18 expend the funds appropriated in this subsection as provided 7 19 in the federal law making the funds available and in 7 20 conformance with chapter 17A. 7 21 2. An amount not exceeding 3 percent of the funds 7 22 appropriated in subsection 1 shall be used by the drug policy 7 23 coordinator for administrative expenses. From the funds set 7 24 aside by this subsection for administrative expenses, the drug 7 25 policy coordinator shall pay to the auditor of state an amount 7 26 sufficient to pay the cost of auditing the use and 7 27 administration of the state's portion of the funds 7 28 appropriated in subsection 1. 7 29 Sec. 8. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE 7 30 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from 7 31 the fund created in section 8.41 to the office of the governor 7 32 for the drug policy coordinator for the federal fiscal year 7 33 beginning October 1, 2002, and ending September 30, 2003, the 7 34 following amount: 7 35 .................................................. $ 838,162 8 1 Funds appropriated in this section are the funds 8 2 anticipated to be received from the federal government for the 8 3 designated federal fiscal year under 42 U.S.C., chapter 136, 8 4 which provides grants for substance abuse treatment programs 8 5 in state and local correctional facilities. The drug policy 8 6 coordinator shall expend the funds appropriated in this 8 7 section as provided in the federal law making the funds 8 8 available and in conformance with chapter 17A. 8 9 Sec. 9. COMMUNITY SERVICES APPROPRIATIONS. 8 10 1. a. There is appropriated from the fund created by 8 11 section 8.41 to the division of community action agencies of 8 12 the department of human rights for the federal fiscal year 8 13 beginning October 1, 2002, and ending September 30, 2003, the 8 14 following amount: 8 15 .................................................. $ 7,001,652 8 16 Funds appropriated in this subsection are the funds 8 17 anticipated to be received from the federal government for the 8 18 designated federal fiscal year under 42 U.S.C., chapter 106, 8 19 which provides for the community services block grant. The 8 20 division of community action agencies of the department of 8 21 human rights shall expend the funds appropriated in this 8 22 subsection as provided in the federal law making the funds 8 23 available and in conformance with chapter 17A. 8 24 b. The administrator of the division of community action 8 25 agencies of the department of human rights shall allocate not 8 26 less than 96 percent of the amount of the block grant to 8 27 eligible community action agencies for programs benefiting 8 28 low-income persons. Each eligible agency shall receive a 8 29 minimum allocation of not less than $100,000. The minimum 8 30 allocation shall be achieved by redistributing increased funds 8 31 from agencies experiencing a greater share of available funds. 8 32 The funds shall be distributed on the basis of the poverty- 8 33 level population in the area represented by the community 8 34 action areas compared to the size of the poverty-level 8 35 population in the state. 9 1 2. An amount not exceeding 4 percent of the funds 9 2 appropriated in subsection 1 shall be used by the division of 9 3 community action agencies of the department of human rights 9 4 for administrative expenses. From the funds set aside by this 9 5 subsection for administrative expenses, the division of 9 6 community action agencies of the department of human rights 9 7 shall pay to the auditor of state an amount sufficient to pay 9 8 the cost of auditing the use and administration of the state's 9 9 portion of the funds appropriated in subsection 1. The 9 10 auditor of state shall bill the division of community action 9 11 agencies for the costs of the audits. 9 12 Sec. 10. COMMUNITY DEVELOPMENT APPROPRIATIONS. 9 13 1. There is appropriated from the fund created by section 9 14 8.41 to the Iowa department of economic development for the 9 15 federal fiscal year beginning October 1, 2002, and ending 9 16 September 30, 2003, the following amount: 9 17 .................................................. $ 31,843,420 9 18 Funds appropriated in this subsection are the funds 9 19 anticipated to be received from the federal government for the 9 20 designated federal fiscal year under 42 U.S.C., chapter 69, 9 21 which provides for community development block grants. The 9 22 Iowa department of economic development shall expend the funds 9 23 appropriated in this subsection as provided in the federal law 9 24 making the funds available and in conformance with chapter 9 25 17A. 9 26 2. An amount not exceeding $1,444,840 for the federal 9 27 fiscal year beginning October 1, 2002, shall be used by the 9 28 Iowa department of economic development for administrative 9 29 expenses for the community development block grant. The total 9 30 amount used for administrative expenses includes $722,420 for 9 31 the federal fiscal year beginning October 1, 2002, of funds 9 32 appropriated in subsection 1 and a matching contribution from 9 33 the state equal to $722,420 from the appropriation of state 9 34 funds for the community development block grant and state 9 35 appropriations for related activities of the Iowa department 10 1 of economic development. From the funds set aside for 10 2 administrative expenses by this subsection, the Iowa 10 3 department of economic development shall pay to the auditor of 10 4 state an amount sufficient to pay the cost of auditing the use 10 5 and administration of the state's portion of the funds 10 6 appropriated in subsection 1. The auditor of state shall bill 10 7 the department for the costs of the audit. 10 8 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS. 10 9 1. There is appropriated from the fund created by section 10 10 8.41 to the division of community action agencies of the 10 11 department of human rights for the federal fiscal year 10 12 beginning October 1, 2002, and ending September 30, 2003, the 10 13 following amount: 10 14 .................................................. $ 31,126,126 10 15 The funds appropriated in this subsection are the funds 10 16 anticipated to be received from the federal government for the 10 17 designated federal fiscal year under 42 U.S.C., chapter 94, 10 18 subchapter II, which provides for the low-income home energy 10 19 assistance block grants. The division of community action 10 20 agencies of the department of human rights shall expend the 10 21 funds appropriated in this subsection as provided in the 10 22 federal law making the funds available and in conformance with 10 23 chapter 17A. 10 24 2. Up to 15 percent of the amount appropriated in this 10 25 section that is actually received shall be used for 10 26 residential weatherization or other related home repairs for 10 27 low-income households. Of this allocation amount, not more 10 28 than 10 percent may be used for administrative expenses. In 10 29 order to receive low-income home energy assistance program 10 30 funding, the head of an eligible household must be willing to 10 31 allow residential weatherization or other related home 10 32 repairs. However, if the eligible household is located in 10 33 rental property, the unwillingness of the property owner to 10 34 allow residential weatherization or other related home repairs 10 35 shall not prevent the eligible household from receiving low- 11 1 income home energy assistance program funding. 11 2 3. After subtracting the allocation in subsection 2, up to 11 3 $2,645,721 is allocated for administrative expenses of the 11 4 low-income home energy assistance program of which $290,000 is 11 5 allocated for administrative expenses of the division. The 11 6 costs of auditing the use and administration of the portion of 11 7 the appropriation in this section that is retained by the 11 8 state shall be paid from the amount allocated in this 11 9 subsection to the division. The auditor of state shall bill 11 10 the division for the audit costs. 11 11 4. The remainder of the appropriation in this section 11 12 following the allocations made in subsections 2 and 3, shall 11 13 be used to help eligible households as defined in 42 U.S.C., 11 14 chapter 94, subchapter II, to meet home energy costs. 11 15 5. Not more than 10 percent of the amount appropriated in 11 16 this section that is actually received, may be carried forward 11 17 for use in the succeeding federal fiscal year. 11 18 6. Expenditures for assessment and resolution of energy 11 19 problems shall be limited to 5 percent of the amount 11 20 appropriated in this section that is actually received. 11 21 Sec. 12. SOCIAL SERVICES APPROPRIATIONS. 11 22 1. There is appropriated from the fund created by section 11 23 8.41 to the department of human services for the federal 11 24 fiscal year beginning October 1, 2002, and ending September 11 25 30, 2003, the following amount: 11 26 .................................................. $ 17,578,482 11 27 Funds appropriated in this subsection are the funds 11 28 anticipated to be received from the federal government for the 11 29 designated federal fiscal year under 42 U.S.C., chapter 7, 11 30 subchapter XX, which provides for the social services block 11 31 grant. The department of human services shall expend the 11 32 funds appropriated in this subsection as provided in the 11 33 federal law making the funds available and in conformance with 11 34 chapter 17A. 11 35 2. Not more than $1,117,773 of the funds appropriated in 12 1 subsection 1 shall be used by the department of human services 12 2 for general administration. From the funds set aside in this 12 3 subsection for general administration, the department of human 12 4 services shall pay to the auditor of state an amount 12 5 sufficient to pay the cost of auditing the use and 12 6 administration of the state's portion of the funds 12 7 appropriated in subsection 1. 12 8 3. In addition to the allocation for general 12 9 administration in subsection 2, the remaining funds 12 10 appropriated in subsection 1 shall be allocated in the 12 11 following amounts to supplement appropriations for the federal 12 12 fiscal year beginning October 1, 2002, for the following 12 13 programs within the department of human services: 12 14 a. Field operations: 12 15 .................................................. $ 6,685,525 12 16 b. Child and family services: 12 17 .................................................. $ 999,969 12 18 c. Local administrative costs and other local services: 12 19 .................................................. $ 709,019 12 20 d. Volunteers: 12 21 .................................................. $ 77,490 12 22 e. Community-based services: 12 23 .................................................. $ 89,111 12 24 f. MH/MR/DD/BI community service (local purchase): 12 25 .................................................. $ 7,899,595 12 26 Sec. 13. SOCIAL SERVICES BLOCK GRANT PLAN. The department 12 27 of human services during each state fiscal year shall develop 12 28 a plan for the use of federal social services block grant 12 29 funds for the subsequent state fiscal year. 12 30 The proposed plan shall include all programs and services 12 31 at the state level which the department proposes to fund with 12 32 federal social services block grant funds, and shall identify 12 33 state and other funds which the department proposes to use to 12 34 fund the state programs and services. 12 35 The proposed plan shall also include all local programs and 13 1 services which are eligible to be funded with federal social 13 2 services block grant funds, the total amount of federal social 13 3 services block grant funds available for the local programs 13 4 and services, and the manner of distribution of the federal 13 5 social services block grant funds to the counties. The 13 6 proposed plan shall identify state and local funds which will 13 7 be used to fund the local programs and services. 13 8 The proposed plan shall be submitted with the department's 13 9 budget requests to the governor and the general assembly. 13 10 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM 13 11 HOMELESSNESS. Upon receipt of the minimum formula grant from 13 12 the federal alcohol, drug abuse, and mental health 13 13 administration to provide mental health services for the 13 14 homeless, for the federal fiscal year beginning October 1, 13 15 2002, and ending September 30, 2003, the division of mental 13 16 health and developmental disabilities of the department of 13 17 human services shall assure that a project which receives 13 18 funds under the formula grant from either the federal or local 13 19 match share of 25 percent in order to provide outreach 13 20 services to persons who are chronically mentally ill and 13 21 homeless or who are subject to a significant probability of 13 22 becoming homeless shall do all of the following: 13 23 1. Provide community mental health services, diagnostic 13 24 services, crisis intervention services, and habilitation and 13 25 rehabilitation services. 13 26 2. Refer clients to medical facilities for necessary 13 27 hospital services, and to entities that provide primary health 13 28 services and substance abuse services. 13 29 3. Provide appropriate training to persons who provide 13 30 services to persons targeted by the grant. 13 31 4. Provide case management to homeless persons. 13 32 5. Provide supportive and supervisory services to certain 13 33 homeless persons living in residential settings which are not 13 34 otherwise supported. 13 35 6. Projects may expend funds for housing services 14 1 including minor renovation, expansion and repair of housing, 14 2 security deposits, planning of housing, technical assistance 14 3 in applying for housing, improving the coordination of housing 14 4 services, the costs associated with matching eligible homeless 14 5 individuals with appropriate housing, and one-time rental 14 6 payments to prevent eviction. 14 7 7. If the department has data indicating that a geographic 14 8 area has a substantial number of persons with mental illness 14 9 who are homeless and are not being served by an existing 14 10 grantee for that area under the formula grant and the existing 14 11 grantee has expressed a desire to no longer provide services 14 12 or the grantee's contract was terminated by the department for 14 13 nonperformance, the department shall issue a request for 14 14 proposals to replace the grantee. Otherwise, the department 14 15 shall maximize available funding by continuing to contract to 14 16 the extent possible with those persons who are grantees as of 14 17 the effective date of this subsection. The department shall 14 18 issue a request for proposals if additional funding becomes 14 19 available for expansion to persons who are not being served 14 20 and it is not possible to utilize existing grantees. 14 21 Sec. 15. CHILD CARE AND DEVELOPMENT APPROPRIATION. There 14 22 is appropriated from the fund created by section 8.41 to the 14 23 department of human services for the federal fiscal year 14 24 beginning October 1, 2002, and ending September 30, 2003, the 14 25 following amount: 14 26 .................................................. $ 40,975,932 14 27 Funds appropriated in this section are the funds 14 28 anticipated to be received from the federal government under 14 29 42 U.S.C., chapter 105, subchapter II-B, which provides for 14 30 the child care and development block grant. The department 14 31 shall expend the funds appropriated in this section as 14 32 provided in the federal law making the funds available and in 14 33 conformance with chapter 17A. 14 34 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS. 14 35 1. If the funds received from the federal government for 15 1 the block grants specified in this Act are less than the 15 2 amounts appropriated, the funds actually received shall be 15 3 prorated by the governor for the various programs, other than 15 4 for the services to victims of sex offenses and for rape 15 5 prevention education under section 4, subsection 2, of this 15 6 Act, for which each block grant is available according to the 15 7 percentages that each program is to receive as specified in 15 8 this Act. However, if the governor determines that the funds 15 9 allocated by the percentages will not be sufficient to effect 15 10 the purposes of a particular program, or if the appropriation 15 11 is not allocated by percentage, the governor may allocate the 15 12 funds in a manner which will effect to the greatest extent 15 13 possible the purposes of the various programs for which the 15 14 block grants are available. 15 15 2. Before the governor implements the actions provided for 15 16 in subsection 1, the following procedures shall be taken: 15 17 a. The chairpersons and ranking members of the senate and 15 18 house standing committees on appropriations, the appropriate 15 19 chairpersons and ranking members of subcommittees of those 15 20 committees, the director of the legislative service bureau, 15 21 and the director of the legislative fiscal bureau shall be 15 22 notified of the proposed action. 15 23 b. The notice shall include the proposed allocations, and 15 24 information on the reasons why particular percentages or 15 25 amounts of funds are allocated to the individual programs, the 15 26 departments and programs affected, and other information 15 27 deemed useful. Chairpersons notified shall be allowed at 15 28 least two weeks to review and comment on the proposed action 15 29 before the action is taken. 15 30 3. If the amount of moneys received from the federal 15 31 government for a specific grant number specified in this Act 15 32 is less than the amount appropriated, the amount appropriated 15 33 shall be reduced accordingly. An annual report listing any 15 34 such appropriation reduction shall be submitted to the fiscal 15 35 committee of the legislative council. 16 1 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS. 16 2 1. If funds received from the federal government in the 16 3 form of block grants exceed the amounts appropriated in 16 4 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess 16 5 shall be prorated to the appropriate programs according to the 16 6 percentages specified in those sections, except additional 16 7 funds shall not be prorated for administrative expenses. 16 8 2. If actual funds received from the federal government 16 9 from block grants exceed the amount appropriated in section 11 16 10 of this Act for the low-income home energy assistance program, 16 11 not more than 15 percent of the excess may be allocated to the 16 12 low-income residential weatherization program and not more 16 13 than 5 percent of the excess may be used for administrative 16 14 costs. 16 15 3. If funds received from the federal government from 16 16 community services block grants exceed the amount appropriated 16 17 in section 9 of this Act, 100 percent of the excess is 16 18 allocated to the community services block grant program. 16 19 4. If the amount of moneys received from the federal 16 20 government for a specific grant number specified in this Act 16 21 exceeds the amount appropriated, the excess amount is 16 22 appropriated for the purpose designated in the specific 16 23 grant's appropriation. An annual report listing any such 16 24 excess appropriations shall be submitted to the fiscal 16 25 committee of the legislative council. 16 26 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL 16 27 FUNDS. If other federal grants, receipts, and funds and other 16 28 nonstate grants, receipts, and funds become available or are 16 29 awarded which are not available or awarded during the period 16 30 in which the general assembly is in session, but which require 16 31 expenditure by the applicable department or agency prior to 16 32 March 15 of the fiscal year beginning July 1, 2002, and ending 16 33 June 30, 2003, these grants, receipts, and funds are 16 34 appropriated to the extent necessary, provided that the fiscal 16 35 committee of the legislative council is notified within thirty 17 1 days of receipt of the grants, receipts, or funds and the 17 2 fiscal committee of the legislative council has an opportunity 17 3 to comment on the expenditure of the grants, receipts, or 17 4 funds. 17 5 Sec. 19.
