  1  1    Section 1.  Section 670.4, subsection 15, Code 2001, is
  1  2 amended to read as follows:
  1  3    15.  Any claim based upon or arising out of an act or
  1  4 omission of an officer or employee of the municipality or the
  1  5 municipality's governing body by a person skateboarding, or
  1  6 in-line skating, sledding, snowboarding, canoeing, or kayaking
  1  7 on public property when the person knew or reasonably should
  1  8 have known that the skateboarding, or in-line skating,
  1  9 sledding, snowboarding, canoeing, or kayaking created a
  1 10 substantial risk of injury to the person and was voluntarily
  1 11 in the place of risk.  The exemption from liability contained
  1 12 in this subsection shall only apply to claims for injuries or
  1 13 damage resulting from the risks inherent in the activities of
  1 14 skateboarding, or in-line skating, sledding, snowboarding,
  1 15 canoeing, or kayaking.  
  1 16                           EXPLANATION
  1 17    This bill amends Code section 670.4 regarding acts or
  1 18 omissions of a municipality's employees in regard to sledding,
  1 19 snowboarding, canoeing, or kayaking.  The bill provides an
  1 20 exemption from liability for municipalities relating to claims
  1 21 based upon acts or omissions of an officer or employee of the
  1 22 municipality by a person engaged in sledding, snowboarding,
  1 23 canoeing, or kayaking on public property when the person knew
  1 24 or reasonably should have known that the sledding,
  1 25 snowboarding, canoeing, or kayaking created a substantial risk
  1 26 of injury and the person was acting voluntarily.  A
  1 27 municipality in Code chapter 670 is a city, county, township,
  1 28 school district, or other unit of local government.
