PAG LIN 1 1 Section 1. Section 312.14, Code 2001, as amended by 2001 1 2 Iowa Acts, chapter 32, section 5, is amended to read as 1 3 follows: 1 4 312.14 CITIES TO SUBMIT REPORT. 1 5 1.Cities in the state which receive allotmentsA city 1 6 that receives an allotment of funds from road use tax funds 1 7 shall prepare and deliver on or before September 30 each year 1 8 to the department an annual report showing all street receipts 1 9 and expenditures for the city for the previous fiscal year. 1 10 2. The report shall include a detailed cost accounting of 1 11 all instances of the use of day labor or public or private 1 12 contracts for construction, reconstruction, or improvement 1 13 projects on the municipal street system during the previous 1 14 fiscal year, in the manner prescribed by rule of the 1 15 department under section 314.1A. The report shall also 1 16 include the costs of purchasing, leasing, or renting 1 17 construction or maintenance equipment and an accounting of the 1 18 use of such equipment for construction, reconstruction, or 1 19 improvement projects on the municipal street system during the 1 20 previous fiscal year. This subsection does not apply to a 1 21 city with a population of five thousand or less. 1 22 Sec. 2. Section 312.15, Code 2001, is amended to read as 1 23 follows: 1 24 312.15 WHEN FUNDS NOT ALLOCATED. 1 25 1. Funds shall not be allocated toanya city untilsuch1 26 the cityshall have compliedcomplies withthe provisions of1 27sectionssection 312.11 and section 312.14, if required to do 1 28 so. 1 29 2. If a city has not complied withthe provisions of1 30 section 312.14, the treasurer of state shall withhold funds 1 31 allocated to the city until the city complies. If a city has 1 32 not complied with the provisions of section 312.14 by December 1 33 31 following the date the report was required, funds shall not 1 34 be allocated to the city until the city has complied and all 1 35 funds withheld under thisparagraphsubsection shall revert to 2 1 the street construction fund of the cities. 2 2 3. The department shall notify the treasurer of state if 2 3anya city fails to comply withthe provisions of sections2 4 section 312.11andor 312.14. 2 5 EXPLANATION 2 6 This bill exempts cities with a population of 5,000 or less 2 7 from a provision enacted in 2001 and effective July 1, 2002, 2 8 that requires a city that receives an allotment of funds from 2 9 road use tax funds to annually make a detailed cost accounting 2 10 of the use of day labor or public or private contracts for 2 11 construction, reconstruction, or improvement projects on the 2 12 municipal street system during the prior fiscal year and to 2 13 annually account for the use of and report the costs of 2 14 purchasing, leasing, or renting construction or maintenance 2 15 equipment. By providing such exemption, the bill also 2 16 excludes such a city from a possible withholding by the 2 17 treasurer of state of a city's allotment of funds from road 2 18 use tax funds due to failure to timely submit the detailed 2 19 information. 2 20 LSB 6569HC 79 2 21 nh/cls/14 2 22
