PAG LIN 1 1 Section 1. Section 473.19, Code 2001, is amended to read 1 2 as follows: 1 3 473.19 ENERGY BANK PROGRAM. 1 4 1. The energy bank program is established by the 1 5 department. The energy bank program consists of the following1 6forms ofto provide assistanceforto qualifying entities, 1 7 including but not limited to the state, state agencies, 1 8 political subdivisions of the state, school districts, area 1 9 education agencies, community colleges, and nonprofit 1 10 organizations:. A business or building located in any of the 1 11 following shall be considered a qualifying entity: 1 12 a. A designated federal or state enterprise zone. 1 13 b. A difficult-to-develop area or qualified census tract 1 14 designated by the United States department of housing and 1 15 urban development. 1 16 c. An urban renewal area under chapter 403. 1 17 d. A main street demonstration project under the main 1 18 street program administered by the department of economic 1 19 development. 1 20 e. An affordable housing project as designated by either 1 21 the Iowa finance authority or the department of economic 1 22 development. 1 23 2. The energy bank program consists of the following forms 1 24 of assistance: 1 251.a. Providing moneys from the petroleum overcharge fund 1 26 for conducting energy audits for school districts under 1 27 section 279.44, for conducting comprehensive engineering 1 28 analyses for school districts and for conducting energy audits 1 29 and comprehensive engineering analyses for state agencies, and 1 30 political subdivisions of the state. 1 312.b. Providing loans, leases, and other methods of 1 32 alternative financing from the energy loan fund established in 1 33 section 473.20 and section 473.20A forthe state, state1 34agencies, political subdivisions of the state, school1 35districts, area education agencies, community colleges, and2 1nonprofit organizationsqualifying entities to implement 2 2 energy conservation measures. 2 33.c. Serving as a source of technical support for energy 2 4 conservation management. 2 54.d. Providing assistance for obtaining insurance on the 2 6 energy savings expected to be realized from the implementation 2 7 of energy conservation measures. 2 85.e. Providing self-liquidating financing forthe state,2 9state agencies, political subdivisions of the state, school2 10districts, area education agencies, community colleges, and2 11nonprofit organizationsqualifying entities pursuant to 2 12 section 473.20A. 2 13 3. For the purpose of this section, section 473.20, and 2 14 section 473.20A, "energy conservation measure" means 2 15 construction, rehabilitation, acquisition, or modification of 2 16 an installation in a facility or vehicle which is intended to 2 17 reduce energy consumption, or energy costs, or both, or allow 2 18 the use of an alternative energy source, which may contain 2 19 integral control and measurement devices. "Nonprofit 2 20 organization" means an organization exempt from federal income 2 21 taxation under section 501(c)(3) of the Internal Revenue Code. 2 22 EXPLANATION 2 23 This bill amends the energy bank program by adding entities 2 24 to the list of qualifying entities under the program. 2 25 Currently, the state, state agencies, political 2 26 subdivisions of the state, school districts, area education 2 27 agencies, community colleges, and nonprofit organizations may 2 28 receive assistance under the energy bank program. The bill 2 29 adds to the list of qualifying businesses any business or 2 30 building located in a designated federal or state enterprise 2 31 zone, a difficult-to-develop area or qualified census tract, 2 32 an urban renewal area, a main street demonstration project, or 2 33 an affordable housing project. 2 34 LSB 6683YC 79 2 35 tm/cf/24
