1 1 Section 1. Section 22.7, subsection 36, Code Supplement
1 2 2001, is amended to read as follows:
1 3 36. Records of a law enforcement agency or the state
1 4 department of transportation regarding the issuance of vehicle
1 5 registration plates under section 321.19, subsection 1A, or
1 6 the issuance of a driver's license under section 321.189A.
1 7 Sec. 2. Section 321.19, Code 2001, is amended by adding
1 8 the following new subsection:
1 9 NEW SUBSECTION. 1A. A vehicle owned or leased by the
1 10 state, a county, a municipality, or other political
1 11 subdivision of the state for a period of less than sixty days
1 12 that is used or intended to be used for undercover law
1 13 enforcement purposes is exempt from the payment of the
1 14 registration fees imposed by this chapter. The director of
1 15 transportation may order the issuance of regular registration
1 16 plates for such exempt undercover vehicles. The department,
1 17 in cooperation with the commissioner of public safety, shall
1 18 adopt rules pursuant to chapter 17A regarding the issuance,
1 19 use, and cancellation of registration plates issued pursuant
1 20 to this subsection. The department shall keep as confidential
1 21 public records under section 22.7, all records regarding
1 22 registration plates issued under this subsection. This
1 23 subsection shall not be construed to exempt a vehicle or the
1 24 owner or operator of a vehicle described in this subsection
1 25 from the penalties provided in this chapter.

1 27 EXPLANATION
1 28 This bill provides that vehicles owned or leased by the
1 29 state, counties, municipalities, and other political
1 30 subdivisions for less than 60 days are exempt from the payment
1 31 of vehicle registration fees pursuant to Code chapter 321 if
1 32 the vehicles are used or intended to be used for undercover
1 33 law enforcement purposes.
1 34 The bill also provides that the director of transportation
1 35 may order the issuance of regular registration plates for
2 1 exempt vehicles used or intended to be used by peace officers
2 2 for undercover law enforcement.
2 3 The bill provides that the state department of
2 4 transportation and the commissioner of public safety shall
2 5 cooperate to adopt rules pursuant to Code chapter 17A
2 6 regarding the issuance, use, and cancellation of registration
2 7 plates pursuant to the bill and that all records regarding
2 8 such registration plates shall be kept as confidential public
2 9 records under Code section 22.7, subsection 36.
