PAG LIN 1 1 Section 1. Section 80A.4, Code 2001, is amended to read as 1 2 follows: 1 3 80A.4 LICENSE REQUIREMENTS. 1 4 1. Applications for a license or license renewal shall be 1 5 submitted to the commissioner in the form the commissioner 1 6 prescribes. A license or license renewal shall not be issued 1 7 unless the applicant: 1 8 a. Is eighteen years of age or older. 1 9 b. Is not a peace officer. 1 10 c. Has never been convicted of a felony or aggravated 1 11 misdemeanor. 1 12 d. Is not addicted to the use of alcohol or a controlled 1 13 substance. 1 14 e. Does not have a history of repeated acts of violence. 1 15 f. Is of good moral character and has not been judged 1 16 guilty of a crime involving moral turpitude. 1 17 g. Has not been convicted of a crime described in section 1 18 708.3, 708.4, 708.5, 708.6, 708.8, or 708.9. 1 19 h. Has not been convicted of illegally using, carrying or 1 20 possessing a dangerous weapon. 1 21 i. Has not been convicted of fraud. 1 22 j. Provides fingerprints to the department. 1 23j.k. Complies with other qualifications and requirements 1 24 the commissioner adopts by rule. 1 25 2. If the applicant is a corporation, the requirements of 1 26 subsection 1 apply to the president and to each officer, 1 27 commissioner or employee who is actively involved in the 1 28 licensed business in Iowa. If the applicant is a partnership 1 29 or association, the requirements of subsection 1 apply to each 1 30 partner or association member. 1 31 3. Each employee of an applicant or licensee shall possess 1 32 the same qualifications required by subsection 1of this1 33sectionfor a licensee. 1 34 4. The fingerprints required by subsection 1 may be 1 35 submitted by the department to the federal bureau of 2 1 investigation through the state central criminal history 2 2 repository for the purpose of a national criminal history 2 3 check. 2 4 Sec. 2. Section 80A.5, subsections 1 and 2, Code 2001, are 2 5 amended to read as follows: 2 6 1. An applicant for a license or license renewal shall 2 7 deposit with each application the fee for the license and if 2 8 necessary the fees associated with processing the 2 9 fingerprints. 2 10 2. If the application is approved the deposited amount 2 11 shall be applied on the license fee. If the application is 2 12 disapproved, the deposited amount excluding the fees 2 13 associated with the processing of the fingerprints shall be 2 14 refunded to the applicant. 2 15 Sec. 3. Section 80A.7, subsection 2, Code 2001, is amended 2 16 to read as follows: 2 17 2. The fee for each application for an identification card 2 18 is ten dollars. 2 19 Sec. 4. Section 80A.7, Code 2001, is amended by adding the 2 20 following new subsection: 2 21 NEW SUBSECTION. 5. An application for an identification 2 22 card shall include the submission of fingerprints of the 2 23 person seeking the identification card which fingerprints may 2 24 be submitted to the federal bureau of investigation through 2 25 the state central criminal history repository for the purpose 2 26 of a national criminal history background check. Fees 2 27 associated with the processing of fingerprints shall be 2 28 assessed to the employing licensee. 2 29 Sec. 5. Section 99D.8A, subsection 2, Code 2001, is 2 30 amended to read as follows: 2 31 2. An applicant shall submit pictures, fingerprints, and 2 32 descriptions of physical characteristics to the commission in 2 33 the manner prescribed on the application forms. The 2 34 fingerprints may be submitted to the federal bureau of 2 35 investigation by the department of public safety through the 3 1 state central criminal history repository for the purpose of a 3 2 national criminal history check. 3 3 Sec. 6. Section 99E.9, subsection 2, Code 2001, is amended 3 4 to read as follows: 3 5 2. Subject to the approval of the board, the commissioner 3 6 may enter into contracts for the operation and marketing of 3 7 the lottery, except that the board may by rule designate 3 8 classes of contracts other than major procurements which do 3 9 not require prior approval by the board. A major procurement 3 10 shall be as the result of competitive bidding with the 3 11 contract being awarded to the responsible vendor submitting 3 12 the lowest and best proposal. However, before a contract for 3 13 a major procurement is awarded, the division of criminal 3 14 investigation of the department of public safety shall conduct 3 15 a thorough background investigation of the vendor, any parent 3 16 or subsidiary corporation of the vendor, all shareholders of 3 17 five percent or more interest of the vendor or parent or 3 18 subsidiary corporation of the vendor, and all officers and 3 19 directors of the vendor or parent or subsidiary corporation of 3 20 the vendor to whom the contract is to be awarded. The vendor 3 21 shall submit to the division of criminal investigation 3 22 appropriate investigation authorizations to facilitate this 3 23 investigation, including authorization to take fingerprints. 3 24 The fingerprints may be submitted to the federal bureau of 3 25 investigation by the department of public safety through the 3 26 state central criminal history repository for the purpose of a 3 27 national criminal history check. A contract for a major 3 28 procurement awarded or entered into by the commissioner with 3 29 an individual or business organization shall require that 3 30 individual or business organization to establish a permanent 3 31 office in this state. As used in this subsection, "major 3 32 procurement" means consulting agreements and the major 3 33 procurement contract with a business organization for the 3 34 printing of tickets, or for purchase or lease of equipment or 3 35 services essential to the operation of a lottery game. 4 1 Sec. 7. Section 99F.6, subsection 2, Code 2001, is amended 4 2 to read as follows: 4 3 2. An applicant shall submit pictures, fingerprints, and 4 4 descriptions of physical characteristics to the commission in 4 5 the manner prescribed on the application forms. The 4 6 fingerprints may be submitted to the federal bureau of 4 7 investigation by the department of public safety through the 4 8 state central criminal history repository for the purpose of a 4 9 national criminal history check. 4 10 Sec. 8. EFFECTIVE DATE. This Act, being deemed of 4 11 immediate importance, takes effect upon enactment. 4 12 EXPLANATION 4 13 This bill relates to criminal history checks of applicants 4 14 for certain licenses and by major vendors contracting with the 4 15 lottery. 4 16 The amendments to Code chapter 80A relate to applications 4 17 to conduct a bail enforcement business, or a private 4 18 investigation or security business. The bill requires that, 4 19 upon an application for a license or license renewal, the 4 20 applicant and employees of the applicant shall submit 4 21 fingerprints to the department of public safety. The bill 4 22 permits the department to submit the fingerprints to the 4 23 federal bureau of investigation for the purpose of a national 4 24 criminal history check. The bill also permits the department 4 25 to assess a fee for processing the fingerprints. 4 26 The amendment to Code section 99D.8A relates to an 4 27 application for a license to conduct pari-mutuel wagering. 4 28 Current law requires that an applicant for a license to 4 29 conduct pari-mutuel wagering submit fingerprints with the 4 30 application. The bill permits the department of public safety 4 31 to submit the fingerprints to the federal bureau of 4 32 investigation for the purpose of a national criminal history 4 33 check. 4 34 The amendment to Code section 99E.9 relates to vendors 4 35 conducting business with the lottery. The bill requires a 5 1 major vendor to submit fingerprints to the department so that 5 2 the fingerprints may be submitted to the federal bureau of 5 3 investigation for the purpose of a national criminal history 5 4 check. 5 5 The amendment to Code section 99F.6 relates to an 5 6 application for a license to operate gambling games at a pari- 5 7 mutuel dog or horse racetrack, to operate an excursion 5 8 gambling boat and to conduct gambling games on the boat. 5 9 Current law requires that an applicant for a license submit 5 10 fingerprints with the application. The bill permits the 5 11 department of public safety to submit the fingerprints to the 5 12 federal bureau of investigation for the purpose of a national 5 13 criminal history check. 5 14 The bill takes effect upon enactment. 5 15 LSB 5109DP 79 5 16 jm/pj/5.1
