PAG LIN 1 1 Section 1. PESTICIDE CERTIFICATION RENEWAL FOR PRIVATE 1 2 APPLICATORS ONE-YEAR SUSPENSION. If a person is certified 1 3 as a private applicator of pesticides on the effective date of 1 4 this Act, and absent this Act would be required to complete an 1 5 educational program on or before June 30, 2003, in order to 1 6 renew the certification pursuant to section 206.5, the person 1 7 may complete the educational program at any time up to the 1 8 one-year anniversary of the date that the person would have 1 9 been required to complete the educational program, 1 10 notwithstanding section 206.5. 1 11 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 12 immediate importance, takes effect upon enactment. 1 13 EXPLANATION 1 14 This bill amends Code section 206.5, providing for the 1 15 certification of pesticide applicators, including commercial, 1 16 public, and private applicators. To be initially certified as 1 17 a commercial, public, or private applicator, a person must 1 18 complete an educational program that consists of passing an 1 19 examination. After initial certification, the commercial, 1 20 public, or private applicator must renew the certification by 1 21 again completing the educational program. For renewal, the 1 22 educational program consists of either an examination or 1 23 continuing instructional courses. The commercial, public, or 1 24 private applicator must pass the examination each third year 1 25 following initial certification or may elect to attend two 1 26 hours of continuing instructional courses each year. 1 27 The bill provides if a person is certified as a private 1 28 applicator of pesticides on the effective date of the bill and 1 29 would otherwise be required to complete an educational program 1 30 on or before June 30, 2003, in order to renew the 1 31 certification, the person may complete the educational program 1 32 at any time up to the one-year anniversary of the date that 1 33 the person would have been required to complete the 1 34 educational program, notwithstanding Code section 206.5. 1 35 The bill takes effect upon enactment. 2 1 LSB 5387HC 79 2 2 da/pj/5
