1 1 Section 1. Section 321J.21, Code 2001, is amended to read
1 2 as follows:
1 3 321J.21 DRIVING WHILE LICENSE SUSPENDED, DENIED, REVOKED,
1 4 OR BARRED.
1 5 1. A person whose driver's license or nonresident
1 6 operating privilege has been suspended, denied, revoked, or
1 7 barred due to a violation of this chapter and who drives a
1 8 motor vehicle upon the highways of this state while the
1 9 license or privilege is suspended, denied, revoked, or barred
1 10 commits a serious misdemeanor. In addition to any other
1 11 penalties, the punishment imposed for a violation of this
1 12 subsection shall include assessment of a fine of one thousand
1 13 dollars.
1 14 2. In addition to the fine, the department, upon receiving
1 15 the record of the conviction of a person under this section
1 16 upon a charge of driving a motor vehicle upon the highways of
1 17 this state while the license of the person was suspended,
1 18 denied, revoked, or barred shall extend the period of
1 19 suspension, denial, revocation, or bar for an additional like
1 20 period, and the department shall not issue a new license
1 21 during the additional period.
1 22 EXPLANATION
1 23 This bill provides that a person whose driver's license or
1 24 nonresident operating privilege has been suspended, denied,
1 25 revoked, or barred for a violation of the operating while
1 26 intoxicated (OWI) provisions of the Code commits the crime of
1 27 driving while the person's license or privilege is suspended,
1 28 denied, revoked, or barred only if the person drives a motor
1 29 vehicle upon the highways of this state while the sanction is
1 30 in place. Currently, Code section 321J.21 provides that a
1 31 person commits such a crime if the person drives a motor
1 32 vehicle anywhere while the sanction is in place. The bill
1 33 aligns the OWI driving while sanctioned provisions with the
1 34 driving while sanctioned provisions in Code section 321.218.
