  1  1    Section 1.  Section 321.285, subsection 6, Code Supplement
  1  2 2001, is amended to read as follows:
  1  3    6.  a.  Notwithstanding any other speed restrictions, the
  1  4 speed limit for all vehicular traffic on fully controlled-
  1  5 access, divided, multilaned highways including the national
  1  6 system of interstate highways is sixty-five miles per hour.
  1  7 However, the speed limit for all vehicular traffic on
  1  8 interstate highway 29 and interstate highway 35, which have
  1  9 been identified as high priority corridors pursuant to }
  1 10 1105(c) of the federal Intermodal Surface Transportation
  1 11 Efficiency Act of 1991, as amended by } 332(a) of the federal
  1 12 National Highway Designation Act of 1995 and } 1211(i) of the
  1 13 Transportation Equity Act for the 21st Century, is seventy
  1 14 miles per hour, except that the speed limit on such highways
  1 15 for vehicles with a gross weight exceeding ten thousand pounds
  1 16 is sixty-five miles per hour.  The department may establish a
  1 17 speed limit of sixty-five miles per hour on certain divided,
  1 18 multilaned highways not otherwise described in this paragraph.
  1 19    b.  However, the The department, or cities a city with the
  1 20 approval of the department, may establish a lower speed limit
  1 21 upon such highways on a highway described in this subsection
  1 22 that is located within the corporate limits of a city.
  1 23    c.  For the purposes of this subsection, a fully
  1 24 controlled-access highway is a highway that gives preference
  1 25 to through traffic by providing access connections with
  1 26 selected public roads only and by prohibiting crossings at
  1 27 grade or direct private driveway connections.
  1 28    d.  A minimum speed may be established by the department on
  1 29 the highways referred to in this subsection if warranted by
  1 30 engineering and traffic investigations.
  1 31    e.  It is further provided that any Any kind of vehicle,
  1 32 implement, or conveyance incapable of attaining and
  1 33 maintaining a speed of forty miles per hour shall be
  1 34 prohibited from using the interstate system.  
  1 35                           EXPLANATION
  2  1    This bill increases the speed limit for interstate highways
  2  2 29 and 35, which have been identified by federal law as high
  2  3 priority corridors, from 65 to 70 miles per hour for all
  2  4 vehicles except vehicles with a gross weight exceeding 10,000
  2  5 pounds.  Federal law identifies interstate 29, interstate 35,
  2  6 and the avenue of the Saints (a portion of which is interstate
  2  7 380) as high priority corridors.  The bill retains the current
  2  8 provision that allows the state department of transportation,
  2  9 or a city with the approval of the department, to establish a
  2 10 lower speed limit for such a highway located within the
  2 11 corporate limits of a city.
