  1  1    Section 1.  Section 40.1, Code 2001, is amended by striking
  1  2 the section and inserting in lieu thereof the following:
  1  3    40.1  CONGRESSIONAL DISTRICTS.
  1  4    The state of Iowa is hereby organized and divided into five
  1  5 congressional districts, which shall be composed,
  1  6 respectively, of the following counties:
  1  7    1.  The first district shall consist of the counties of
  1  8 Butler, Bremer, Fayette, Clayton, Black Hawk, Buchanan,
  1  9 Delaware, Dubuque, Jones, Jackson, Clinton, and Scott.
  1 10    2.  The second district shall consist of the counties of
  1 11 Linn, Johnson, Cedar, Washington, Louisa, Muscatine, Wapello,
  1 12 Jefferson, Henry, Des Moines, Wayne, Appanoose, Davis, Van
  1 13 Buren, and Lee.
  1 14    3.  The third district shall consist of the counties of
  1 15 Grundy, Tama, Benton, Polk, Jasper, Poweshiek, Iowa, Marion,
  1 16 Mahaska, Keokuk, Lucas, and Monroe.
  1 17    4.  The fourth district shall consist of the counties of
  1 18 Emmet, Kossuth, Winnebago, Worth, Mitchell, Howard,
  1 19 Winneshiek, Allamakee, Palo Alto, Hancock, Cerro Gordo, Floyd,
  1 20 Chickasaw, Pocahontas, Humboldt, Wright, Franklin, Calhoun,
  1 21 Webster, Hamilton, Hardin, Greene, Boone, Story, Marshall,
  1 22 Dallas, Madison, and Warren.
  1 23    5.  The fifth district shall consist of the counties of
  1 24 Lyon, Osceola, Dickinson, Sioux, O'Brien, Clay, Plymouth,
  1 25 Cherokee, Buena Vista, Woodbury, Ida, Sac, Monona, Crawford,
  1 26 Carroll, Harrison, Shelby, Audubon, Guthrie, Pottawattamie,
  1 27 Cass, Adair, Mills, Montgomery, Adams, Union, Clarke, Fremont,
  1 28 Page, Taylor, Ringgold, and Decatur.
  1 29    Sec. 2.  Section 41.1, Code 2001, is amended by striking
  1 30 the section and inserting in lieu thereof the following:
  1 31    41.1  REPRESENTATIVE DISTRICTS.
  1 32    The state of Iowa is hereby divided into one hundred
  1 33 representative districts as follows:
  1 34    1.  The first representative district in Woodbury county
  1 35 shall consist of that portion of the city of Sioux City
  2  1 bounded by a line commencing at the point the boundary of the
  2  2 state of Iowa intersects the north boundary of Woodbury
  2  3 county, then proceeding east along the boundary of Woodbury
  2  4 county until it intersects Hamilton boulevard, then proceeding
  2  5 southwesterly along Hamilton boulevard until it intersects
  2  6 Buckwalter drive, then proceeding easterly, then southerly,
  2  7 along Buckwalter drive until it intersects Outer Drive North,
  2  8 then proceeding west along Outer Drive North until it
  2  9 intersects Cheyenne boulevard, then proceeding south along
  2 10 Cheyenne boulevard until it intersects Thirty-seventh street,
  2 11 then proceeding west and then north along Thirty-seventh
  2 12 street until it intersects Thirty-eighth street, then
  2 13 proceeding west along Thirty-eighth street until it intersects

  3 14    2.  The second representative district in Woodbury county
  3 15 shall consist of that portion of the city of Sioux City
  3 16 bounded by a line commencing at the point the north boundary
  3 17 of Woodbury county intersects Hamilton boulevard, then
  3 18 proceeding east along the boundary of Woodbury county until it
  3 19 intersects the east corporate limit of the city of Sioux City,
  3 20 then proceeding southerly along the corporate limits of the
  3 21 city of Sioux City until it intersects Correctionville road,
  3 22 then proceeding west along Correctionville road until it
  3 23 intersects South Westcott street, then proceeding south along
  3 24 South Westcott street until it intersects Gordon drive, then
  3 25 proceeding west along Gordon drive until it intersects South
  3 26 Court street, then proceeding south along South Court street
  3 27 and its extension to the Missouri river until it intersects
  3 28 the boundary of the state of Iowa, then proceeding westerly

  5  2    3.  The third representative district shall consist of:
  5  3    a.  In Sioux county:
  5  4    (1)  The city of Orange City.
  5  5    (2)  Buncombe, Logan, Nassau, Reading, Sherman, and
  5  6 Washington townships.
  5  7    b.  In Plymouth county, Elgin, Grant, Hancock, Johnson,
  5  8 Liberty, Perry, Plymouth, Portland, Preston, Sioux, Stanton,
  5  9 Washington, Westfield, and America townships.
  5 10    4.  The fourth representative district shall consist of:
  5 11    a.  Lyon county.
  5 12    b.  In Sioux county, Capel, Eagle, Garfield, Lincoln,
  5 13 Settlers, Sheridan, Sioux, Welcome, West Branch, Center,
  5 14 Plato, and Rock townships, and that portion of Holland
  5 15 township lying outside the corporate limits of the city of
  5 16 Orange City.
  5 17    5.  The fifth representative district shall consist of:
  5 18    a.  Osceola county.
  5 19    b.  O'Brien county.
  5 20    c.  In Sioux county, East Orange, Floyd, Grant, and Lynn
  5 21 townships.
  5 22    d.  In Clay county, Clay, Douglas, Garfield, Herdland,
  5 23 Lincoln, Logan, Lone Tree, Peterson, Riverton, Summit,
  5 24 Waterford, and Gillett Grove townships.
  5 25    6.  The sixth representative district shall consist of:
  5 26    a.  Dickinson county.
  5 27    b.  In Clay county:
  5 28    (1)  The city of Spencer.
  5 29    (2)  Freeman, Lake, Meadow, and Sioux townships.
  5 30    7.  The seventh representative district shall consist of:
  5 31    a.  Emmet county.
  5 32    b.  Palo Alto county.
  5 33    c.  In Kossuth county:
  5 34    (1)  The cities of Wesley and West Bend.
  5 35    (2)  Buffalo, Burt, Eagle, German, Grant, Greenwood,
  6  1 Harrison, Hebron, Lincoln, Lotts Creek, Portland, Ramsey,
  6  2 Seneca, Springfield, Swea, Wesley, Fenton, Ledyard, and Plum
  6  3 Creek townships.
  6  4    (3)  That portion of Union township bounded by a line
  6  5 commencing at the point the east boundary of Union township
  6  6 intersects the north corporate limit of the city of Algona,
  6  7 then proceeding first north, and then in a counterclockwise
  6  8 manner along the boundary of Union township until it
  6  9 intersects the west corporate limit of the city of Algona and
  6 10 the east boundary of Cresco township, then proceeding first
  6 11 north, and then in a clockwise manner along the corporate
  6 12 limits of the city of Algona to the point of origin.
  6 13    8.  The eighth representative district shall consist of:
  6 14    a.  Humboldt county.
  6 15    b.  Pocahontas county.
  6 16    c.  In Kossuth county:
  6 17    (1)  The city of Algona.
  6 18    (2)  Irvington, Luverne, Riverdale, Sherman, Whittemore,
  6 19 and Cresco townships, that portion of Garfield township lying
  6 20 outside the corporate limits of the city of West Bend, that
  6 21 portion of Prairie township lying outside the corporate limits
  6 22 of the city of Wesley, and that portion of Union township not
  6 23 contained in the seventh representative district.
  6 24    d.  In Webster county, Deer Creek, Jackson, and Johnson
  6 25 townships.
  6 26    9.  The ninth representative district shall consist of:
  6 27    a.  The city of Dows.
  6 28    b.  Wright county.
  6 29    c.  In Hamilton county:
  6 30    (1)  The city of Webster City.
  6 31    (2)  Blairsburg, Cass, Clear Lake, Freedom, Fremont,
  6 32 Hamilton, Independence, Marion, Webster, and Williams
  6 33 townships.
  6 34    d.  In Webster county, Hardin, Pleasant Valley, Sumner,
  6 35 Webster, and Yell townships, and that portion of Washington
  7  1 township lying outside the corporate limits of the city of
  7  2 Duncombe.
  7  3    10.  The tenth representative district shall consist of:
  7  4    a.  In Story county:
  7  5    (1)  The city of Kelley.
  7  6    (2)  Collins, Howard, Indian Creek, Lafayette, Lincoln,
  7  7 Milford, Nevada, New Albany, Palestine, Richland, Sherman,
  7  8 Union, and Warren townships, and that portion of Grant
  7  9 township not contained in the forty-fifth representative
  7 10 district.
  7 11    b.  In Hamilton county, Ellsworth, Lincoln, Lyon, Rose
  7 12 Grove, Scott, and Liberty townships.
  7 13    11.  The eleventh representative district shall consist of:
  7 14    a.  Winnebago county.
  7 15    b.  Worth county.
  7 16    c.  In Hancock county:
  7 17    (1)  The city of Garner.
  7 18    (2)  Bingham, Boone, Britt, Concord, Crystal, Ellington,
  7 19 Erin, Garfield, Madison, Magor, and Orthel townships.
  7 20    12.  The twelfth representative district shall consist of:
  7 21    a.  In Cerro Gordo county:
  7 22    (1)  The city of Clear Lake.
  7 23    (2)  Bath, Clear Lake, Dougherty, Falls, Geneseo, Grant,
  7 24 Grimes, Lake, Lime Creek, Lincoln, Mount Vernon, Pleasant
  7 25 Valley, and Union townships.
  7 26    b.  In Franklin county:
  7 27    (1)  The cities of Hampton and Sheffield.
  7 28    (2)  Geneva, Grant, Hamilton, Ingham, Lee, Marion, Mott,
  7 29 Oakland, Reeve, Richland, Ross, Scott, West Fork, and Wisner
  7 30 townships, that portion of Morgan township lying outside the
  7 31 corporate limits of the city of Dows, and that portion of
  7 32 Osceola township not contained in the forty-fourth
  7 33 representative district.
  7 34    c.  In Hancock county, Amsterdam, Avery, Liberty, and Twin
  7 35 Lake townships, and that portion of Ell township lying outside
  8  1 the corporate limits of the city of Garner.
  8  2    13.  The thirteenth representative district in Cerro Gordo
  8  3 county shall consist of:
  8  4    a.  The city of Mason City.
  8  5    b.  That portion of Mason township lying north of the
  8  6 corporate limits of the city of Mason City.
  8  7    14.  The fourteenth representative district shall consist
  8  8 of:
  8  9    a.  The city of Riceville.
  8 10    b.  Floyd county.
  8 11    c.  Mitchell county.
  8 12    d.  In Cerro Gordo county, Owen and Portland townships, and
  8 13 that portion of Mason township not contained in the thirteenth
  8 14 representative district.
  8 15    15.  The fifteenth representative district shall consist
  8 16 of:
  8 17    a.  Chickasaw county.
  8 18    b.  That portion of Howard county lying outside the
  8 19 corporate limits of the city of Riceville.
  8 20    c.  In Winneshiek county, Calmar, Fremont, Jackson,
  8 21 Lincoln, Madison, Military, Orleans, Sumner, and Washington
  8 22 townships.
  8 23    16.  The sixteenth representative district shall consist
  8 24 of:
  8 25    a.  Allamakee county.
  8 26    b.  In Winneshiek county, Bloomfield, Bluffton, Burr Oak,
  8 27 Canoe, Decorah, Frankville, Glenwood, Hesper, Highland,
  8 28 Pleasant, and Springfield townships.
  8 29    17.  The seventeenth representative district shall consist
  8 30 of:
  8 31    a.  Butler county.
  8 32    b.  In Bremer county:
  8 33    (1)  The city of Waverly.
  8 34    (2)  Douglas, Lafayette, Polk, Warren, and Washington
  8 35 townships, that portion of Jackson township lying outside the
  9  1 corporate limits of the city of Janesville, and that portion
  9  2 of Jefferson township lying outside the corporate limits of
  9  3 the city of Denver.
  9  4    18.  The eighteenth representative district shall consist
  9  5 of:
  9  6    a.  The cities of Sumner and Janesville.
  9  7    b.  In Black Hawk county, Bennington, Mt. Vernon, and
  9  8 Washington townships, and that portion of Lester township
  9  9 lying outside the corporate limits of the city of Dunkerton.
  9 10    c.  In Bremer county:
  9 11    (1)  The city of Denver.
  9 12    (2)  Franklin, Frederika, Fremont, Le Roy, Maxfield,
  9 13 Dayton, and Sumner townships.
  9 14    d.  In Fayette county:
  9 15    (1)  The city of West Union.
  9 16    (2)  Auburn, Banks, Bethel, Center, Clermont, Dover, Eden,
  9 17 Fremont, Harlan, Jefferson, Windsor, and Union townships, and
  9 18 that portion of Oran township lying outside the corporate
  9 19 limits of the city of Fairbank.
  9 20    19.  The nineteenth representative district in Black Hawk
  9 21 county shall consist of:
  9 22    a.  Union township and that portion of Cedar Falls township
  9 23 lying outside the corporate limits of the city of Cedar Falls.
  9 24    b.  That portion of the city of Cedar Falls bounded by a
  9 25 line commencing at the point the east corporate limit of the
  9 26 city of Cedar Falls intersects Greenhill drive and its
  9 27 extension to the corporate limits, then proceeding west along
  9 28 Greenhill drive and its extension until it intersects Hillside
  9 29 drive, then proceeding north along Hillside drive until it
  9 30 intersects Valley High drive, then proceeding west along
  9 31 Valley High drive until it intersects Clearview drive, then
  9 32 proceeding north along Clearview drive until it intersects
  9 33 Primrose drive, then proceeding west along Primrose drive
  9 34 until it intersects Rownd street, then proceeding north along
  9 35 Rownd street until it intersects Orchard drive, then
 10  1 proceeding west along Orchard drive until it intersects
 10  2 McClain drive, then proceeding north along McClain drive until

 10 21    b.  That portion of the city of Waterloo bounded by a line
 10 22 commencing at the point Hawkeye road intersects the south
 10 23 corporate limit of the city of Waterloo, then proceeding north
 10 24 along Hawkeye road until it intersects East San Marnan drive,
 10 25 then proceeding west along East San Marnan drive until it
 10 26 intersects Kimball avenue, then proceeding north along Kimball
 10 27 avenue until it intersects West Ridgeway avenue, then
 10 28 proceeding west along West Ridgeway avenue until it intersects
 10 29 Sheridan road, then proceeding north along Sheridan road until
 10 30 it intersects Berkshire road, then proceeding first west, and
 10 31 then northwest, along Berkshire road until it intersects
 10 32 Hampshire road, then proceeding north along Hampshire road
 10 33 until it intersects West Fourth street, then proceeding
 10 34 northeast along West Fourth street until it intersects

 11 10 corporate limits of the city of Waterloo, then proceeding

 11 13 origin.
 11 14    c.  That portion of the city of Cedar Falls bounded by a
 11 15 line commencing at the point the east corporate limit of the
 11 16 city of Cedar Falls intersects Greenhill drive and its
 11 17 extension to the corporate limits, then proceeding west along
 11 18 Greenhill drive and its extension until it intersects Hillside
 11 19 drive, then proceeding north along Hillside drive until it
 11 20 intersects Valley High drive, then proceeding west along
 11 21 Valley High drive until it intersects Clearview drive, then
 11 22 proceeding north along Clearview drive until it intersects
 11 23 Primrose drive, then proceeding west along Primrose drive
 11 24 until it intersects Rownd street, then proceeding north along
 11 25 Rownd street until it intersects Orchard drive, then
 11 26 proceeding west along Orchard drive until it intersects

 12 11    b.  That portion of the city of Waterloo bounded by a line
 12 12 commencing at the point Hawkeye road intersects the south
 12 13 corporate limit of the city of Waterloo, then proceeding north
 12 14 along Hawkeye road until it intersects East San Marnan drive,
 12 15 then proceeding west along East San Marnan drive until it
 12 16 intersects Kimball avenue, then proceeding north along Kimball
 12 17 avenue until it intersects West Ridgeway avenue, then
 12 18 proceeding west along West Ridgeway avenue until it intersects
 12 19 Sheridan road, then proceeding north along Sheridan road until
 12 20 it intersects Berkshire road, then proceeding first west, and
 12 21 then northwest, along Berkshire road until it intersects

 74  1    98.  The ninety-eighth representative district shall
 74  2 consist of:
 74  3    a.  In Mills county:
 74  4    (1)  The city of Glenwood.
 74  5    (2)  Glenwood, Ingraham, Lyons, Plattville, Saint Marys,
 74  6 and Oak townships.
 74  7    b.  In Pottawattamie county:
 74  8    (1)  The city of Oakland.
 74  9    (2)  Belknap, Carson, Garner, Grove, Hardin, James, Keg
 74 10 Creek, Macedonia, Silver Creek, Washington, and York
 74 11 townships, that portion of Minden township lying outside the
 74 12 corporate limits of the city of Neola, that portion of
 74 13 Pleasant township lying outside the corporate limits of the
 74 14 city of Shelby, and those portions of Garner, Lake, and Lewis
 74 15 townships lying outside the corporate limits of the city of
 74 16 Council Bluffs.
 74 17    (3)  That portion of the city of Council Bluffs bounded by
 74 18 a line commencing at the point McPherson avenue intersects the
 74 19 east corporate limit of the city of Council Bluffs, then
 74 20 proceeding first east, and then in a clockwise manner along
 74 21 the corporate limits of the city of Council Bluffs until it
 74 22 intersects Valley View drive, then proceeding northerly along
 74 23 Valley View drive until it intersects Madison avenue, then
 74 24 proceeding westerly along Madison avenue until it intersects
 74 25 Bennett avenue, then proceeding northeasterly along Bennett
 74 26 avenue until it intersects Franklin avenue, then proceeding
 74 27 northwesterly along Franklin avenue until it intersects
 74 28 Lincoln avenue, then proceeding northwesterly along Lincoln

 75  4 the boundary of the state of Iowa and the south boundary of
 75  5 Lake township, then proceeding first east, and then in a
 75  6 clockwise manner along the corporate limits of the city of
 75  7 Council Bluffs until it intersects McPherson avenue, then
 75  8 proceeding westerly along McPherson avenue until it intersects
 75  9 Gleason avenue, then proceeding westerly along Gleason avenue
 75 10 until it intersects Morningside avenue, then proceeding north

 76 26    100.  The one hundredth representative district in
 76 27 Pottawattamie county shall consist of:
 76 28    a.  That portion of the city of Council Bluffs bounded by a
 76 29 line commencing at the point the Chicago Central and Pacific
 76 30 Railroad track intersects the boundary of the state of Iowa,
 76 31 then proceeding first southwesterly, and then in a
 76 32 counterclockwise manner along the corporate limits of the city
 76 33 of Council Bluffs until it intersects Fawn Park drive and
 76 34 Valley View drive, then proceeding northerly along Valley View
 76 35 drive until it intersects Madison avenue, then proceeding
 77  1 westerly along Madison avenue until it intersects Bennett
 77  2 avenue, then proceeding northeasterly along Bennett avenue
 77  3 until it intersects Franklin avenue, then proceeding
 77  4 northwesterly along Franklin avenue until it intersects Hazel
 77  5 street, then proceeding south along Hazel street until it

 78 13    b.  The city of Carter Lake.
 78 14    Sec. 3.  MEMBERSHIP.
 78 15    1.  CONGRESSIONAL DISTRICTS.  Each congressional district
 78 16 established by section 1 of this Act shall elect one
 78 17 representative for a term of two years in 2002 and every
 78 18 subsequent even-numbered year.
 78 19    2.  STATE SENATE AND HOUSE DISTRICTS.  The membership of
 78 20 the senate and house of representatives in the eightieth and
 78 21 subsequent general assemblies shall be determined as follows:
 78 22    a.  Each representative district established by section 2
 78 23 of this Act shall elect one representative for a term of two
 78 24 years in 2002 and every subsequent even-numbered year.
 78 25    b.  Each odd-numbered senatorial district established by
 78 26 section 41.2 which the general assembly adopts by reference,
 78 27 and section 2 of this Act, shall elect a senator in 2002 for a
 78 28 four-year term commencing in January 2003.  If an incumbent
 78 29 senator who was elected to a four-year term which commenced in
 78 30 January 2001, or was subsequently elected to fill a vacancy in
 78 31 such a term, is residing in an odd-numbered senatorial
 78 32 district on February 1, 2002, that senator's term of office
 78 33 shall be terminated on January 1, 2003.
 78 34    c.  Each even-numbered senatorial district established by
 78 35 section 41.2 which the general assembly adopts by reference,
 79  1 and section 2 of this Act, shall elect a senator in 2004 for a
 79  2 four-year term commencing in January 2005.
 79  3    (1)  If one and only one incumbent state senator is
 79  4 residing in an even-numbered senatorial district on February
 79  5 1, 2002, and that senator meets all of the following
 79  6 requirements, the senator shall represent the district in the
 79  7 senate for the Eightieth General Assembly:
 79  8    (a)  The senator was elected to a four-year term which
 79  9 commenced in January 2001 or was subsequently elected to fill
 79 10 a vacancy in such a term.
 79 11    (b)  The senatorial district in the plan which includes the
 79 12 place of residence of the state senator on the date of the
 79 13 senator's last election to the senate is the same as the even-
 79 14 numbered senatorial district in which the senator resides on
 79 15 February 1, 2002, or is contiguous to such even-numbered
 79 16 senatorial district and the senator's declared residence as of
 79 17 February 1, 2002, was within the district from which the
 79 18 senator was last elected.  Areas which meet only at the points
 79 19 of adjoining corners are not contiguous.
 79 20    (2)  Each even-numbered senatorial district to which
 79 21 subparagraph (1) of this paragraph "c" is not applicable shall
 79 22 elect a senator in 2002 for a two-year term commencing in
 79 23 January 2003.  However, if more than one incumbent state
 79 24 senator is residing in an even-numbered senatorial district on
 79 25 February 1, 2002, and, on or before February 15, 2002, all but
 79 26 one of the incumbent senators resigns from office effective no
 79 27 later than January 1, 2003, the remaining incumbent senator
 79 28 shall represent the district in the senate for the Eightieth
 79 29 General Assembly.  A copy of the resignation must be filed in
 79 30 the office of the secretary of state no later than five p.m.
 79 31 on February 15, 2002.
 79 32    d.  To fulfill the purposes of this subsection, the
 79 33 secretary of state shall prescribe a form to be completed by
 79 34 all senators to declare their residences as of February 1,
 79 35 2002.  The form shall be filed with the secretary of state no
 80  1 later than five p.m. on February 1, 2002.
 80  2    Sec. 4.  VACANCIES.
 80  3    1.  MEMBER OF CONGRESS.  If a special election to fill a
 80  4 vacancy for a representative in Congress occurs or exists
 80  5 after the effective date of this Act, at a time which makes it
 80  6 necessary to fill the vacancy at a special election held
 80  7 pursuant to section 69.14, the vacancy shall be filled from
 80  8 the same district provided in chapter 40, Code 2001, which
 80  9 elected the representative whose seat is vacant.  This
 80 10 subsection does not apply if a special election is not
 80 11 required under section 69.14.
 80 12    2.  MEMBER OF GENERAL ASSEMBLY.  If a vacancy in the
 80 13 general assembly occurs or exists after the effective date of
 80 14 this Act, at a time which makes it necessary to fill the
 80 15 vacancy at a special election held pursuant to section 69.14,
 80 16 the vacancy shall be filled from the same district provided in
 80 17 chapter 41, Code 2001, which elected the senator or
 80 18 representative whose seat is vacant.  This subsection does not
 80 19 apply if a special election is not required under section
 80 20 69.14.
 80 21    3.  REPEAL.  This section is repealed January 1, 2003.
 80 22    Sec. 5.  GEOGRAPHY.  For purposes of this Act, each
 80 23 reference to a specific city or township means the city or
 80 24 township as its boundary existed on January 1, 2000, the
 80 25 official date for establishing such boundaries under the 2000
 80 26 United States decennial census.  Also, for purposes of this
 80 27 Act, such reference to a street or other boundary means such
 80 28 street or boundary as they are delineated on the official Pub.
 80 29 L. No. 94-171 census maps.
 80 30    Sec. 6.  EFFECTIVE DATE.  This Act, being deemed of
 80 31 immediate importance, takes effect upon enactment.  
 80 32                           EXPLANATION
 80 33    This bill establishes congressional and legislative
 80 34 districts for the state effective during the 2002 and
 80 35 subsequent general elections.  Current Code section 41.2
 81  1 provides that state senate districts are composed of two state
 81  2 representative districts and specifies which numbered
 81  3 representative districts make up each numbered senate
 81  4 district.  The bill takes effect upon enactment.
