  1  1    Section 1.  Section 40.1, Code 2001, is amended by striking
  1  2 the section and inserting in lieu thereof the following:
  1  3    40.1  CONGRESSIONAL DISTRICTS.
  1  4    The state of Iowa is hereby organized and divided into five
  1  5 congressional districts, which shall be composed,
  1  6 respectively, of the following counties:
  1  7    1.  The first district shall consist of the counties of
  1  8 Clayton, Delaware, Dubuque, Linn, Jones, Jackson, Clinton,
  1  9 Cedar, and Scott.
  1 10    2.  The second district shall consist of the counties of
  1 11 Jasper, Poweshiek, Warren, Marion, Mahaska, Keokuk,
  1 12 Washington, Johnson, Louisa, Muscatine, Union, Clarke, Lucas,
  1 13 Monroe, Wapello, Jefferson, Henry, Des Moines, Decatur, Wayne,
  1 14 Appanoose, Davis, Van Buren, and Lee.
  1 15    3.  The third district shall consist of the counties of
  1 16 Emmet, Kossuth, Winnebago, Worth, Mitchell, Howard,
  1 17 Winneshiek, Allamakee, Hancock, Cerro Gordo, Floyd, Chickasaw,
  1 18 Humboldt, Wright, Franklin, Butler, Bremer, Fayette, Webster,
  1 19 Hamilton, Hardin, Grundy, Black Hawk, Buchanan, Tama, Benton,
  1 20 and Iowa.
  1 21    4.  The fourth district shall consist of the counties of
  1 22 Greene, Boone, Story, Marshall, Dallas, Polk, and Madison.
  1 23    5.  The fifth district shall consist of the counties of
  1 24 Lyon, Osceola, Dickinson, Sioux, O'Brien, Clay, Palo Alto,
  1 25 Plymouth, Cherokee, Buena Vista, Pocahontas, Woodbury, Ida,
  1 26 Sac, Calhoun, Monona, Crawford, Carroll, Harrison, Shelby,
  1 27 Audubon, Guthrie, Pottawattamie, Cass, Adair, Mills,
  1 28 Montgomery, Adams, Fremont, Page, Taylor, and Ringgold.
  1 29    Sec. 2.  Section 41.1, Code 2001, is amended by striking
  1 30 the section and inserting in lieu thereof the following:
  1 31    41.1  REPRESENTATIVE DISTRICTS.
  1 32    The state of Iowa is hereby divided into one hundred
  1 33 representative districts as follows:
  1 34    1.  The first representative district shall consist of:
  1 35    a.  Montgomery county.
  2  1    b.  Page county.
  2  2    c.  In Mills county, Anderson and Deer Creek townships.
  2  3    2.  The second representative district shall consist of:
  2  4    a.  Fremont county.
  2  5    b.  In Mills county:
  2  6    (1)  The city of Malvern.
  2  7    (2)  Center, Glenwood, Ingraham, Lyons, Plattville, Rawles,
  2  8 Saint Marys, Silver Creek, White Cloud, Indian Creek, and Oak
  2  9 townships.
  2 10    c.  In Pottawattamie county:
  2 11    (1)  Lewis township.
  2 12    (2)  That portion of Garner township bounded by a line
  2 13 commencing at the point Franklin avenue intersects the
  2 14 boundary of Garner and Lewis townships and the east corporate
  2 15 limit of the city of Council Bluffs, then proceeding
  2 16 northerly, then westerly, then southwesterly along the east
  2 17 corporate limit of the city of Council Bluffs until the point
  2 18 at which the boundary of Garner and Lewis townships intersects
  2 19 the east corporate limit of the city of Council Bluffs, then
  2 20 easterly along the boundary of Garner township to the point of
  2 21 origin.
  2 22    (3)  That portion of the city of Council Bluffs bounded by
  2 23 a line commencing at the point McPherson avenue intersects the
  2 24 east corporate limit of the city of Council Bluffs, then
  2 25 proceeding first east, and then in a clockwise manner along
  2 26 the corporate limits of the city of Council Bluffs until it
  2 27 intersects Valley View drive, then proceeding northerly along
  2 28 Valley View drive until it intersects Madison avenue, then
  2 29 proceeding westerly along Madison avenue until it intersects
  2 30 Bennett avenue, then proceeding northeasterly along Bennett
  2 31 avenue until it intersects Franklin avenue, then proceeding
  2 32 northwesterly along Franklin avenue until it intersects
  2 33 Lincoln avenue, then proceeding northwesterly along Lincoln
  2 34 avenue until it intersects Park lane, then proceeding east

  3  9 Railroad track intersects the boundary of the state of Iowa,
  3 10 then proceeding first southwesterly, and then in a
  3 11 counterclockwise manner along the corporate limits of the city
  3 12 of Council Bluffs until it intersects Fawn Park drive and
  3 13 Valley View drive, then proceeding northerly along Valley View
  3 14 drive until it intersects Madison avenue, then proceeding
  3 15 westerly along Madison avenue until it intersects Bennett
  3 16 avenue, then proceeding northeasterly along Bennett avenue
  3 17 until it intersects Franklin avenue, then proceeding
  3 18 northwesterly along Franklin avenue until it intersects Hazel
  3 19 street, then proceeding south along Hazel street until it
  3 20 intersects East Palmer avenue, then proceeding west along East

  4 31 limits of the city of Council Bluffs intersect the boundary of
  4 32 the state of Iowa and the south boundary of Lake township,
  4 33 then proceeding first east, and then in a clockwise manner
  4 34 along the corporate limits of the city of Council Bluffs until
  4 35 it intersects McPherson avenue, then proceeding westerly along
  5  1 McPherson avenue until it intersects Gleason avenue, then
  5  2 proceeding westerly along Gleason avenue until it intersects
  5  3 Morningside avenue, then proceeding north along Morningside
  5  4 avenue until it intersects Park lane, then proceeding west
  5  5 along Park lane until it intersects Lincoln avenue, then

  6 19    5.  The fifth representative district shall consist of:
  6 20    a.  Shelby county.
  6 21    b.  In Pottawattamie county:
  6 22    (1)  Pleasant, Knox, Layton, Norwalk, York, James, Valley,
  6 23 Lincoln, Hardin, Washington, Belknap, Center, Wright, Keg
  6 24 Creek, Silver Creek, Carson, Macedonia, Grove, and Waveland
  6 25 townships.
  6 26    (2)  That portion of Garner township not contained in the
  6 27 second representative district, and that portion of Minden
  6 28 township outside the corporate limits of the city of Neola.
  6 29    6.  The sixth representative district shall consist of:
  6 30    a.  Harrison county.
  6 31    b.  In Monona county:
  6 32    (1)  Maple, Cooper, St. Clair, Franklin, Belvidere, Jordan,
  6 33 Soldier, Sherman, Sioux, Spring Valley, and Willow townships,
  6 34 and that portion of Center township outside the corporate
  6 35 limits of the city of Castana.
  7  1    (2)  The city of Onawa.
  7  2    c.  In Pottawattamie county:
  7  3    (1)  Rockford, Boomer, Neola, Crescent, and Hazel Dell
  7  4 townships, and that portion of Lake township outside the
  7  5 corporate limits of the city of Council Bluffs.
  7  6    (2)  The city of Neola.
  7  7    7.  The seventh representative district shall consist of:
  7  8    a.  In Plymouth county, America, Liberty, Plymouth,
  7  9 Stanton, Union, Henry, Hancock, Perry, Hungerford, Lincoln,
  7 10 Elkhorn, and Garfield townships.
  7 11    b.  In Woodbury county, Concord, Banner, Arlington, Floyd,
  7 12 Moville, Grange, West Fork, Lakeport, Sloan, and Willow
  7 13 townships, that portion of Woodbury township not contained in
  7 14 the eighth representative district, and that portion of
  7 15 Liberty township outside the corporate limits of the city of
  7 16 Sergeant Bluff.
  7 17    c.  In Monona county:
  7 18    (1)  Fairview, Lake, West Fork, Grant, Lincoln, Ashton, and
  7 19 Kennebec townships.
  7 20    (2)  The city of Castana.
  7 21    8.  The eighth representative district in Woodbury county
  7 22 shall consist of:
  7 23    a.  Those portions of the city of Sioux City and Woodbury
  7 24 township bounded by a line commencing at the point
  7 25 Correctionville road intersects the east corporate limit of
  7 26 the city of Sioux City, then proceeding first south, and then
  7 27 in a clockwise manner, along the corporate limits of the city
  7 28 of Sioux City until it intersects the corporate limits of the
  7 29 city of Sergeant Bluff, then proceeding first north, and then
  7 30 in a counterclockwise manner along the corporate limits of the
  7 31 city of Sergeant Bluff until it intersects the north boundary
  7 32 of Liberty township, then proceeding westerly along the north
  7 33 boundary of Liberty township until it intersects the boundary
  7 34 of the state of Iowa, then proceeding northerly along the
  7 35 boundary of the state of Iowa until it intersects South Court
  8  1 street and its extension to the Missouri river, then
  8  2 proceeding north along South Court street and its extension
  8  3 until it intersects Gordon drive, then proceeding east along

  8 13 proceeding east along the boundary of Woodbury county until it
  8 14 intersects the east corporate limit of the city of Sioux City,
  8 15 then proceeding southerly along the corporate limits of the
  8 16 city of Sioux City until it intersects Correctionville road,
  8 17 then proceeding west along Correctionville road until it
  8 18 intersects South Westcott street, then proceeding south along

 10  1 county, then proceeding east along the boundary of Woodbury
 10  2 county until it intersects Hamilton boulevard, then proceeding
 10  3 southwesterly along Hamilton boulevard until it intersects
 10  4 Buckwalter drive, then proceeding easterly, then southerly,
 10  5 along Buckwalter drive until it intersects Outer Drive North,
 10  6 then proceeding west along Outer Drive North until it
 10  7 intersects Cheyenne boulevard, then proceeding south along
 10  8 Cheyenne boulevard until it intersects Thirty-seventh street,
 10  9 then proceeding west and then north along Thirty-seventh

 11 12    11.  The eleventh representative district shall consist of:
 11 13    a.  In Crawford county, Boyer, Denison, East Boyer,
 11 14 Goodrich, Iowa, Milford, Nishnabotny, Paradise, Stockholm,
 11 15 Washington, Willow, Hayes, Jackson, Union, and West Side
 11 16 townships.
 11 17    b.  In Carroll county:
 11 18    (1)  Arcadia, Eden, Ewoldt, Roselle, Washington, and Maple
 11 19 River townships, and that portion of Wheatland township
 11 20 outside the corporate limits of the city of Breda.
 11 21    (2)  The cities of Carroll and Manning.
 11 22    12.  The twelfth representative district shall consist of:
 11 23    a.  Cherokee county.
 11 24    b.  Ida county.
 11 25    c.  In Woodbury county, Rutland, Union, Wolf Creek, Kedron,
 11 26 Rock, Grant, Miller, Morgan, Little Sioux, Oto, and Liston
 11 27 townships.
 11 28    d.  In Crawford county, Soldier, Morgan, Otter Creek,
 11 29 Charter Oak, and Hanover townships.
 11 30    13.  The thirteenth representative district shall consist
 11 31 of:
 11 32    a.  In Sioux county:
 11 33    (1)  Buncombe, Eagle, East Orange, Floyd, Garfield,
 11 34 Holland, Logan, Nassau, Reading, Sherman, Washington, West
 11 35 Branch, and Center townships.
 12  1    (2)  The city of Sioux Center.
 12  2    b.  In Plymouth county, Elgin, Fredonia, Grant, Johnson,
 12  3 Marion, Meadow, Portland, Preston, Remsen, Sioux, Washington,
 12  4 and Westfield townships.
 12  5    14.  The fourteenth representative district shall consist
 12  6 of:
 12  7    a.  Lyon county.
 12  8    b.  Osceola county.
 12  9    c.  In Sioux county, Capel, Grant, Lincoln, Lynn, Settlers,
 12 10 Sheridan, Sioux, Plato, and Rock townships, and that portion
 12 11 of Welcome township outside the corporate limits of the city
 12 12 of Sioux Center.
 12 13    15.  The fifteenth representative district shall consist
 12 14 of:
 12 15    a.  O'Brien county.
 12 16    b.  In Clay county:
 12 17    (1)  Clay, Douglas, Lincoln, Lone Tree, Peterson, Riverton,
 12 18 and Waterford townships.
 12 19    (2)  The city of Spencer.
 12 20    16.  The sixteenth representative district shall consist
 12 21 of:
 12 22    a.  Dickinson county.
 12 23    b.  Palo Alto county.
 12 24    c.  In Clay county, Freeman, Garfield, Herdland, Lake,

 74  9 townships.
 74 10    100.  The one hundredth representative district shall
 74 11 consist of:
 74 12    a.  Allamakee county.
 74 13    b.  In Winneshiek county, Bluffton, Burr Oak, Canoe,
 74 14 Fremont, Glenwood, Hesper, Highland, Lincoln, Madison,
 74 15 Orleans, Pleasant, and Decorah townships.
 74 16    Sec. 3.  MEMBERSHIP.
 74 17    1.  CONGRESSIONAL DISTRICTS.  Each congressional district
 74 18 established by section 1 of this Act shall elect one
 74 19 representative for a term of two years in 2002 and every
 74 20 subsequent even-numbered year.
 74 21    2.  STATE SENATE AND HOUSE DISTRICTS.  The membership of
 74 22 the senate and house of representatives in the eightieth and
 74 23 subsequent general assemblies shall be determined as follows:
 74 24    a.  Each representative district established by section 2
 74 25 of this Act shall elect one representative for a term of two
 74 26 years in 2002 and every subsequent even-numbered year.
 74 27    b.  Each odd-numbered senatorial district established by
 74 28 section 41.2 which the general assembly adopts by reference,
 74 29 and section 2 of this Act, shall elect a senator in 2002 for a
 74 30 four-year term commencing in January 2003.  If an incumbent
 74 31 senator who was elected to a four-year term which commenced in
 74 32 January 2001, or was subsequently elected to fill a vacancy in
 74 33 such a term, is residing in an odd-numbered senatorial
 74 34 district on February 1, 2002, that senator's term of office
 74 35 shall be terminated on January 1, 2003.
 75  1    c.  Each even-numbered senatorial district established by
 75  2 section 41.2 which the general assembly adopts by reference,
 75  3 and section 2 of this Act, shall elect a senator in 2004 for a
 75  4 four-year term commencing in January 2005.
 75  5    (1)  If one and only one incumbent state senator is
 75  6 residing in an even-numbered senatorial district on February
 75  7 1, 2002, and that senator meets all of the following
 75  8 requirements, the senator shall represent the district in the
 75  9 senate for the Eightieth General Assembly:
 75 10    (a)  The senator was elected to a four-year term which
 75 11 commenced in January 2001 or was subsequently elected to fill
 75 12 a vacancy in such a term.
 75 13    (b)  The senatorial district in the plan which includes the
 75 14 place of residence of the state senator on the date of the
 75 15 senator's last election to the senate is the same as the even-
 75 16 numbered senatorial district in which the senator resides on
 75 17 February 1, 2002, or is contiguous to such even-numbered
 75 18 senatorial district and the senator's declared residence as of
 75 19 February 1, 2002, was within the district from which the
 75 20 senator was last elected.  Areas which meet only at the points
 75 21 of adjoining corners are not contiguous.
 75 22    (2)  Each even-numbered senatorial district to which
 75 23 subparagraph (1) of this paragraph "c" is not applicable shall
 75 24 elect a senator in 2002 for a two-year term commencing in
 75 25 January 2003.  However, if more than one incumbent state
 75 26 senator is residing in an even-numbered senatorial district on
 75 27 February 1, 2002, and, on or before February 15, 2002, all but
 75 28 one of the incumbent senators resigns from office effective no
 75 29 later than January 1, 2003, the remaining incumbent senator
 75 30 shall represent the district in the senate for the Eightieth
 75 31 General Assembly.  A copy of the resignation must be filed in
 75 32 the office of the secretary of state no later than five p.m.
 75 33 on February 15, 2002.
 75 34    d.  To fulfill the purposes of this subsection, the
 75 35 secretary of state shall prescribe a form to be completed by
 76  1 all senators to declare their residences as of February 1,
 76  2 2002.  The form shall be filed with the secretary of state no
 76  3 later than five p.m. on February 1, 2002.
 76  4    Sec. 4.  VACANCIES.
 76  5    1.  MEMBER OF CONGRESS.  If a special election to fill a
 76  6 vacancy for a representative in Congress occurs or exists
 76  7 after the effective date of this Act, at a time which makes it
 76  8 necessary to fill the vacancy at a special election held
 76  9 pursuant to section 69.14, the vacancy shall be filled from
 76 10 the same district provided in chapter 40, Code 2001, which
 76 11 elected the representative whose seat is vacant.  This section
 76 12 does not apply if a special election is not required under
 76 13 section 69.14.
 76 14    2.  MEMBER OF GENERAL ASSEMBLY.  If a vacancy in the
 76 15 general assembly occurs or exists after the effective date of
 76 16 this Act, at a time which makes it necessary to fill the
 76 17 vacancy at a special election held pursuant to section 69.14,
 76 18 the vacancy shall be filled from the same district provided in
 76 19 chapter 41, Code 2001, which elected the senator or
 76 20 representative whose seat is vacant.  This section does not
 76 21 apply if a special election is not required under section
 76 22 69.14.
 76 23    3.  REPEAL.  This section is repealed January 1, 2003.
 76 24    Sec. 5.  GEOGRAPHY.  For purposes of this Act, each
 76 25 reference to a specific city or township means the city or
 76 26 township as its boundary existed on January 1, 2000, the
 76 27 official date for establishing such boundaries under the 2000
 76 28 United States decennial census.  Also, for purposes of this
 76 29 Act, such reference to a street or other boundary means such
 76 30 street or boundary as they are delineated on the official
 76 31 Public Law 94-171 census maps.
 76 32    Sec. 6.  EFFECTIVE DATE.  This Act, being deemed of
 76 33 immediate importance, takes effect upon enactment.  
 76 34                           EXPLANATION
 76 35    This bill establishes congressional and legislative
 77  1 districts for the state effective during the 2002 and
 77  2 subsequent general elections.  Current Code section 41.2
 77  3 provides that state senate districts are composed of two state
 77  4 representative districts and specifies which numbered
 77  5 representative districts make up each numbered senate
 77  6 district.  The bill takes effect upon enactment.
