1 1 Section 1. NEW SECTION. 709.15A SEXUAL EXPLOITATION BY A
1 2 SCHOOL EMPLOYEE.
1 3 1. As used in this section:
1 4 a. "Intimate relationship" means a relationship for the
1 5 purpose of arousing or satisfying the sexual desires of a
1 6 school employee or student.
1 7 b. "School employee" means an employee of the department
1 8 of education, a school district, or an area education agency.
1 9 c. "Student" means a person enrolled in an elementary or
1 10 secondary school.
1 11 2. Sexual exploitation by a school employee occurs when a
1 12 school employee communicates with a student in person, or by
1 13 telephone, in writing, or via electronic means, for the
1 14 purpose of persuading the student to enter into an intimate
1 15 relationship with the school employee or for the purpose of
1 16 promoting such an intimate relationship.
1 17 3. A school employee who commits sexual exploitation as
1 18 described in subsection 2 commits an aggravated misdemeanor.
1 19 EXPLANATION
1 20 This bill establishes a new criminal offense of sexual
1 21 exploitation by a school employee.
1 22 The bill provides that a school employee commits sexual
1 23 exploitation by a school employee, if the employee
1 24 communicates with a student in person, or by telephone, in
1 25 writing, or via electronic means for the purpose of persuading
1 26 the student to enter into an intimate relationship with the
1 27 school employee or for the purpose of promoting such an
1 28 intimate relationship. A school employee who commits a
1 29 violation of this bill commits an aggravated misdemeanor. An
1 30 aggravated misdemeanor is punishable by confinement for no
1 31 more than two years and a fine of at least $500 but not more
1 32 than $5,000.
1 33 The bill defines "school employee" to mean an employee of
1 34 the department of education, a school district, or an area
1 35 education agency. The bill defines "student" to mean a person
2 1 enrolled in an elementary or secondary school. The bill
2 2 defines an "intimate relationship" to mean a relationship for
2 3 the purpose of arousing or satisfying the sexual desires of
2 4 the school employee or student.
