  1  1    Section 1.  Section 707.5, Code 2001, is amended to read as
  1  2 follows:
  1  3    707.5  INVOLUNTARY MANSLAUGHTER.
  1  4    1.  A person commits a class "D" felony when the person
  1  5 unintentionally causes the death of another person by the
  1  6 commission of a any of the following:
  1  7    a.  A public offense other than a forcible felony or
  1  8 escape.
  1  9    b.  An act committed in a manner likely to cause death or
  1 10 serious injury.
  1 11    2.  A person commits an aggravated misdemeanor when the
  1 12 person unintentionally causes the death of another person by
  1 13 the commission of an act in a manner likely to cause death or
  1 14 serious injury.
  1 15    2.  Involuntary manslaughter as defined in this section is
  1 16 an included offense under an indictment for murder in the
  1 17 first or second degree or voluntary manslaughter.  
  1 18                           EXPLANATION
  1 19    This bill relates to the criminal offense of involuntary
  1 20 manslaughter.
  1 21    The bill changes the penalty for involuntary manslaughter
  1 22 from an aggravated misdemeanor to class "D" felony for a
  1 23 person who unintentionally causes the death of a person by
  1 24 committing an act in a manner likely to cause the death of or
  1 25 serious injury to another.  Current law and the bill provide
  1 26 that a person commits a class "D" felony if the person
  1 27 unintentionally causes the death of another by committing a
  1 28 criminal offense other than a forcible felony or escape.
  1 29    An aggravated misdemeanor is punishable by confinement for
  1 30 no more than two years and a fine of at least $500 but not
  1 31 more than $5,000.  A class "D" felony is punishable by
  1 32 confinement for no more than five years and a fine of at least
  1 33 $750 but not more than $7,500.
