  1  1    Section 1.  NEW SECTION.  414.23A  EXTENDED ZONING
  1  2 JURISDICTION – REFERENDUM.
  1  3    1.  Upon receipt of a petition signed by ten percent of the
  1  4 registered voters of a city and unincorporated area of the
  1  5 county affected by a proposed city zoning ordinance or
  1  6 regulation or an amendment to a city zoning ordinance or
  1  7 regulation, the city council shall submit the proposed zoning
  1  8 ordinance or regulation or amendment to a zoning ordinance or
  1  9 regulation affecting an unincorporated area of the county to
  1 10 the electorate of the city and the affected unincorporated
  1 11 area of the county at a general election or a special
  1 12 election.  The petition must be filed with the city clerk
  1 13 within thirty days after a proposed zoning ordinance or
  1 14 regulation or an amendment to a zoning ordinance or regulation
  1 15 is adopted by the city council.  An election must be called by
  1 16 the city council only if a proposed city zoning ordinance or
  1 17 regulation or an amendment to a city zoning ordinance or
  1 18 regulation affects an unincorporated area pursuant to section
  1 19 414.23.  The notice of election shall be published as provided
  1 20 in section 362.3.
  1 21    2.  The ballot for the election shall be prepared in
  1 22 substantially the form for submitting special questions or
  1 23 proposals at general elections.  If a majority of the
  1 24 registered voters in the city and the unincorporated area
  1 25 affected by a zoning proposal voting on the proposal approve
  1 26 the proposal, the zoning proposal shall take effect as
  1 27 provided by the city council.  Otherwise the proposal is void.  
  1 28                           EXPLANATION
  1 29    This bill provides that, upon receipt of a petition signed
  1 30 by 10 percent of the registered voters of a city and
  1 31 unincorporated area of the county affected by a proposed city
  1 32 zoning ordinance or regulation or an amendment to a city
  1 33 zoning ordinance or regulation, the city council shall submit
  1 34 the proposed zoning ordinance or regulation or amendment to a
  1 35 zoning ordinance or regulation affecting an unincorporated
  2  1 area of the county to the electorate of the city and the
  2  2 affected unincorporated area at a general election or a
  2  3 special election.  An election must be called only if a
  2  4 proposed city zoning ordinance or regulation or an amendment
  2  5 to a city zoning ordinance or regulation affects an
  2  6 unincorporated area pursuant to Code section 414.23.  The
  2  7 petition must be filed with the city clerk within 30 days
  2  8 after a proposed zoning ordinance or regulation or an
  2  9 amendment to a zoning ordinance or regulation is adopted by
  2 10 the city council.  The notice of election shall be published
  2 11 as provided in Code section 362.3.  If the zoning proposal is
  2 12 approved by a majority of the voters voting on the proposal,
  2 13 the zoning proposal takes effect as provided by the city
  2 14 council.  Otherwise the proposal is void.
