1 1 Section 1. Section 331.303, Code 2001, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 8A. Upon petition of a person residing in
1 4 an unincorporated area of a county and affected by a city
1 5 zoning ordinance or regulation or an amendment to a city
1 6 zoning ordinance or regulation, approve or disapprove a city
1 7 zoning ordinance or regulation or an amendment to the
1 8 ordinance or regulation affecting the unincorporated area of
1 9 the county pursuant to section 414.23.
1 10 Sec. 2. Section 414.23, unnumbered paragraph 3, Code 2001,
1 11 is amended to read as follows:
1 12 Property owners affected by such zoning regulations shall
1 13 have the same rights of hearing, protest, and appeal as those
1 14 within the municipality exercising this power. However, upon
1 15 petition of a person residing in an unincorporated area of a
1 16 county and affected by a city zoning ordinance or regulation
1 17 or an amendment to a city zoning ordinance or regulation, the
1 18 city zoning ordinance or regulation or amendment to an
1 19 ordinance or regulation shall not take effect within the
1 20 unincorporated area unless the zoning ordinance or regulation
1 21 or an amendment to an ordinance or regulation is approved by
1 22 the board of supervisors.
1 23 Sec. 3. APPLICABILITY. This Act applies to a city zoning
1 24 ordinance or regulation or an amendment to a city ordinance or
1 25 regulation affecting an unincorporated area of a county, which
1 26 is adopted on or after the effective date of this Act.
1 27 EXPLANATION
1 28 This bill provides that, upon petition of a person residing
1 29 in an unincorporated area of a county and affected by a city
1 30 zoning ordinance or regulation, the city zoning ordinance or
1 31 regulation or an amendment to an ordinance or regulation shall
1 32 not take effect within the unincorporated area unless the
1 33 zoning ordinance or regulation or amendment to the ordinance
1 34 or regulation is approved by the board of supervisors.
1 35 This bill applies to a city zoning ordinance or regulation
2 1 or an amendment to a city zoning ordinance or regulation
2 2 affecting an unincorporated area of the county, which is
2 3 adopted on or after the effective date of this bill.
