1 1 Section 1. NEW SECTION. 7J.1 TRANSACTION FEE AUTHORIZED
1 2 FOR CERTAIN MANUAL FILINGS.
1 3 A state agency may charge an additional amount as a
1 4 transaction fee to a person filing a form as required by the
1 5 state agency when such filing is accomplished using a manual
1 6 filing process; the state agency provides for such filing to
1 7 be accomplished by an electronic filing process; and the
1 8 department of management, upon the request of the state
1 9 agency, determines that such electronic filing process is
1 10 conveniently available to all citizens of this state
1 11 regardless of income or geographic location. A transaction
1 12 fee charged pursuant to this section shall be limited to an
1 13 amount commensurate with the additional cost associated with
1 14 the manual filing process as compared to the electronic filing
1 15 process.
1 16 For purposes of this section, "state agency" means a
1 17 department, office, bureau, division, board, or commission in
1 18 the executive branch of state government.
1 19 Sec. 2. EFFECTIVE DATE. This Act takes effect July 1,
1 20 2004.
1 21 EXPLANATION
1 22 This bill authorizes state agencies to establish and charge
1 23 an additional amount as a transaction fee to a person filing a
1 24 form as required by the state agency when the filing is
1 25 accomplished using a manual filing process; the state agency
1 26 provides for such filing to be accomplished by an electronic
1 27 filing process; and the department of management determines
1 28 that the electronic filing process is conveniently available
1 29 to all citizens of this state regardless of income or
1 30 geographic location. The transaction fee which may be charged
1 31 is limited to an amount commensurate with the additional cost
1 32 associated with the manual filing process as compared to the
1 33 electronic filing process. The bill would become effective
1 34 July 1, 2004.
