PAG LIN 1 1 Section 1. Section 22.7, subsection 10, Code 2001, is 1 2 amended by striking the subsection. 1 3 Sec. 2. Section 22.7, subsection 11, Code 2001, is amended 1 4 to read as follows: 1 5 11. Personal information in confidential personnel and 1 6 payroll records ofpublic bodies including but not limited to1 7cities, boards of supervisors and school districtsgovernment 1 8 bodies that pertain to individuals who are officials, 1 9 officers, or employees of the government bodies. However, the 1 10 following information, pertaining to an individual who is an 1 11 official, officer, or employee of a government body, contained 1 12 in confidential personnel and payroll records shall not be 1 13 confidential: 1 14 a. The name and compensation paid to the individual. 1 15 b. The individual's sick leave, vacation, and other leave 1 16 information. 1 17 c. The date the individual was employed by the government 1 18 body. 1 19 d. The positions the individual holds or has held with the 1 20 government body. 1 21 e. The individual's qualifications for the position that 1 22 the individual holds or has held, including, but not limited 1 23 to, educational background and work experience. 1 24 f. Any disciplinary action taken against the individual 1 25 that resulted in the individual's discharge, suspension, 1 26 demotion, or loss of pay. 1 27 g. Other information for which the legal custodian of the 1 28 information makes a determination that the public's interest 1 29 in access outweighs the individual's interest in 1 30 confidentiality. 1 31 Sec. 3. IMPLEMENTATION OF ACT. Section 25B.2, subsection 1 32 3, shall not apply to this Act. 1 33 EXPLANATION 1 34 This bill alters the confidentiality provisions in the 1 35 public records chapter for personnel and payroll records 2 1 pertaining to officials, officers, and employees of government 2 2 bodies. The confidentiality provision pertaining to personal 2 3 information in confidential records of the military division 2 4 of the department of public defense is stricken in the bill. 2 5 The confidentiality provision pertaining to personnel records 2 6 of other public bodies is expanded to include both personnel 2 7 and payroll records pertaining to officials, officers, and 2 8 employees of government bodies, but certain specific 2 9 information within those confidential records is designated as 2 10 nonconfidential. 2 11 The information designated as nonconfidential includes the 2 12 name and compensation paid to the individual to whom the 2 13 record pertains; the date of employment; positions held; the 2 14 individual's qualifications; any disciplinary action taken 2 15 which resulted in the individual's discharge, suspension, 2 16 demotion, or loss of pay; and any other information for which 2 17 the legal custodian of the information determines that the 2 18 public's interest in access outweighs the individual's 2 19 interest in confidentiality. 2 20 The bill may include a state mandate as defined in Code 2 21 section 25B.3. 2 22 This bill makes inapplicable Code section 25B.2, subsection 2 23 3, which would relieve a political subdivision from complying 2 24 with a state mandate if funding for the cost of the state 2 25 mandate is not provided or specified. Therefore, political 2 26 subdivisions are required to comply with any state mandate 2 27 included in this bill. 2 28 LSB 1201DP 79 2 29 rh/pj/5
