PAG LIN 1 1 Section 1. Section 135C.33, subsection 6, Code 2001, is 1 2 amended to read as follows: 1 3 6. a. The department of inspections and appeals, in 1 4 conjunction with other departments and agencies of state 1 5 government involved with criminal history and abuse registry 1 6 information, shall establish a single contact repository for 1 7 facilities and other providers to have electronic access to 1 8 data to perform background checks for purposes of employment, 1 9 as required of the facilities and other providers under this 1 10 section. 1 11 b. The department may access the single contact repository 1 12 for any of the following purposes: 1 13 (1) To verify data transferred from the department's nurse 1 14 aide registry to the repository. 1 15 (2) To conduct record checks of applicants for employment 1 16 with the department. 1 17 Sec. 2. Section 235A.15, subsection 2, paragraph e, Code 1 18 2001, is amended by adding the following new subparagraph: 1 19 NEW SUBPARAGRAPH. (17) To the department of inspections 1 20 and appeals for purposes of record checks of applicants for 1 21 employment with the department of inspections and appeals. 1 22 Sec. 3. Section 235B.6, subsection 2, paragraph e, Code 1 23 2001, is amended by adding the following new subparagraph: 1 24 NEW SUBPARAGRAPH. (10) The department of inspections and 1 25 appeals for purposes of record checks of applicants for 1 26 employment with the department of inspections and appeals. 1 27 EXPLANATION 1 28 This bill authorizes certain criminal history and abuse 1 29 record and registry access to the department of inspections 1 30 and appeals for purposes of data verification and record 1 31 checks of applicants for employment with the department. 1 32 Code section 135C.33, relating to the single contact 1 33 repository administered by the department of inspections and 1 34 appeals for employment record checks of prospective employees 1 35 of health care facilities, is amended to authorize the 2 1 department itself to access the repository for certain 2 2 purposes. The access is authorized for the department to 2 3 verify data transferred to the repository from the 2 4 department's nurse aide registry and to conduct record checks 2 5 of applicants for employment with the department. 2 6 Code section 235A.15, relating to the central child abuse 2 7 registry, is amended to authorize the department to have 2 8 access to founded child abuse information for purposes of 2 9 record checks of applicants for employment with the 2 10 department. The bill authorizes, for the same purposes, the 2 11 department to have access to dependent adult abuse 2 12 information, other than unfounded information, under Code 2 13 section 235B.6. 2 14 LSB 1147DP 79 2 15 jp/gg/8.1
