1 1 Section 1. The following amendment to the Constitution of
1 2 the State of Iowa is proposed:
1 3 Article I of the Constitution of the State of Iowa is
1 4 amended by adding the following new section which shall be
1 5 applicable to criminal proceedings occurring after
1 6 ratification of this amendment by the electorate:
1 7 RIGHTS OF VICTIMS OF CRIME. SEC. 10A. Victims of crime
1 8 have the right to be treated with fairness, dignity, and
1 9 respect throughout the criminal justice process, to be
1 10 informed of and present during public hearings, and to confer
1 11 with the prosecution, to the extent that exercising these
1 12 rights does not infringe upon the constitutional rights of the
1 13 accused.
1 14 Sec. 2. REFERRAL AND PUBLICATION. The foregoing amendment
1 15 to the Constitution of the State of Iowa is referred to the
1 16 General Assembly to be chosen at the next general election for
1 17 members of the General Assembly, and the Secretary of State is
1 18 directed to cause the same to be published for three
1 19 consecutive months previous to the date of that election as
1 20 provided by law.
1 21 EXPLANATION
1 22 This joint resolution proposes an amendment to the
1 23 Constitution of the State of Iowa regarding the constitutional
1 24 protection for certain rights of the victims of criminal
1 25 offenses. The resolution, if adopted, would be referred to
1 26 the next general assembly, and if again adopted, would be
1 27 submitted to the electorate for ratification, in accordance
1 28 with the procedures detailed in Article X, section 1, of the
1 29 Iowa Constitution.
