PAG LIN 1 1 HOUSE FILE 2616 1 2 1 3 AN ACT 1 4 RELATING TO THE TIME OF POSSESSION OF DEER VENISON, INCREASING 1 5 THE MINIMUM FINE FOR UNLAWFUL TAKING, POSSESSING, INJURING, 1 6 OR TRANSPORTING PROTECTED SPECIES AND GAME, AND SUBJECTING 1 7 VIOLATORS TO A PENALTY. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. Section 481A.32, unnumbered paragraph 1, Code 1 12 2001, is amended to read as follows: 1 13 Whoever shall take, catch, kill, injure, destroy, have in 1 14 possession, buy, sell, ship, or transport any frogs, fish, 1 15 mussels, birds, their nests, eggs, or plumage, fowls, game, or 1 16 animals or their fur or raw pelt in violation of the 1 17 provisions of this chapter or of administrative rules of the 1 18 commission or whoever shall use any device, equipment, seine, 1 19 trap, net, tackle, firearm, drug, poison, explosive, or other 1 20 substance or means, the use of which is prohibited by this 1 21 chapter, or use the same at a time, place, or in a manner or 1 22 for a purpose prohibited, or do any other act in violation of 1 23 the provisions of this chapter or of administrative rules of 1 24 the commission for which no other punishment is provided, is 1 25 guilty of a simple misdemeanor and shall be assessed a minimum 1 26 fine oftentwenty dollars for each offense. 1 27 Sec. 2. Section 481A.57, Code 2001, is amended to read as 1 28 follows: 1 29 481A.57 POSSESSION AND STORAGE. 1 30 A person having lawful possession of game or fur-bearing 1 31 animals or their pelts, except deer venison, may hold them for 1 32 not to exceed thirty days after the close of the open season 1 33 for such game or furbearers. A person having lawful 1 34 possession of deer venison which is taken with a valid deer 1 35 hunting license, may hold the deer venison from the date of 2 1 taking until the following September 1. From September 1 2 2 until the first day of the next deer open season for which the 2 3 person holds a valid deer hunting license, the person shall 2 4 not possess more than twenty-five pounds of deer venison. Any 2 5 person may possess up to twenty-five pounds of deer venison if 2 6 the deer was obtained from a lawful source. A permit to hold 2 7 for a longer period may be granted by the department. 2 8 Sec. 3. Section 805.8B, subsection 3, paragraph e, Code 2 9 Supplement 2001, is amended to read as follows: 2 10 e.
