  1  4 PROVIDING FOR THE CONTROL OF PSEUDORABIES, MAKING
  1  5    PENALTIES APPLICABLE, AND PROVIDING AN EFFECTIVE DATE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 166D.10, subsection 3, paragraph b,
  1 10 Code 2001, is amended to read as follows:
  1 11    b.  For swine which is exposed or swine from a herd of
  1 12 unknown status, a person shall not move or relocate the swine,
  1 13 unless one of the following applies:
  1 14    (1)  The swine reacts negatively to a differentiable test
  1 15 within thirty days prior to moving or relocating the swine.
  1 16    (2)  The swine moves by restricted movement to either a
  1 17 fixed concentration point or slaughtering establishment.
  1 18    Sec. 2.  Section 166D.10, subsection 3, Code 2001, is
  1 19 amended by adding the following new paragraph after paragraph
  1 20 b, and relettering the subsequent paragraph:
  1 21    NEW PARAGRAPH.  bb.  For swine from a herd of unknown
  1 22 status, a person shall not move or relocate the swine, unless
  1 23 one of the following applies:
  1 24    (1)  The swine reacts negatively to a differentiable test
  1 25 within thirty days prior to moving or relocating the swine.
  1 26    (2)  The swine moves by restricted movement to either a
  1 27 fixed concentration point or slaughtering establishment.
  1 28 However, the swine is not required to move by restricted
  1 29 movement, if the swine is moved from a fixed concentration
  1 30 point directly to another fixed concentration point or to a
  1 31 slaughtering establishment.
  1 32    Sec. 3.  Section 166D.10, subsection 4, paragraph b,
  1 33 subparagraph (2), subparagraph subdivision (a), Code 2001, is
  1 34 amended to read as follows:
  1 35    (a)  Except as provided in this subparagraph, the owner of
  2  1 swine shall vaccinate the swine with a modified-live
  2  2 differentiable vaccine, prior to moving swine into the stage
  2  3 II county.  A statistical sampling of the swine moved into a
  2  4 herd as provided in this subparagraph shall be tested using a
  2  5 differentiable test within thirty days after the swine is
  2  6 moved to a herd in this state.  If a swine reacts positively
  2  7 to the test, the herd is an infected herd.  A person is not
  2  8 required to vaccinate swine prior to moving swine into the
  2  9 stage II county or test the swine after the swine has been
  2 10 moved to a herd in the stage II county, if one of the
  2 11 following applies:
  2 12    Sec. 4.  Section 166D.10, subsection 4, paragraph b,
  2 13 subparagraph (2), subparagraph subdivision (b), subparagraph
  2 14 subdivision parts (i) and (ii), Code 2001, are amended to read
  2 15 as follows:
  2 16    (i)  For swine other than swine moved into a herd within a
  2 17 stage II county as an isowean feeder pig, a statistical
  2 18 sampling of the swine moved into the herd shall be tested
  2 19 using a differentiable test within forty-eight hours after the
  2 20 swine moves to a herd in this state.  If a swine reacts
  2 21 positively to the test, the herd is an infected herd.  If,
  2 22 according to the statistical sampling, the swine moved into
  2 23 the herd reacts negatively to the test, all moved the swine
  2 24 must be immediately vaccinated with a differentiable vaccine,
  2 25 as provided in section 166D.11.  The swine shall be considered
  2 26 as part of a herd of unknown status, until tested negative and
  2 27 vaccinated.
  2 28    (ii)  For swine moved into a herd within a stage II county
  2 29 as an isowean feeder pig, a statistical sampling of the swine
  2 30 moved into the herd shall be tested using a differentiable
  2 31 test when a majority of swine moved together into the herd as
  2 32 isowean feeder pigs reach a weight of more than twenty pounds.
  2 33 If a swine reacts positively to the test, the herd is an
  2 34 infected herd.  If, according to the statistical sampling, the
  2 35 swine moved into the herd react negatively to the test, all
  3  1 the swine moved into the herd must be immediately vaccinated
  3  2 with a differentiable vaccine, as provided in section 166D.11.
  3  3 The department may require that the swine be revaccinated with
  3  4 a differentiable vaccine at a later date.  The swine shall be
  3  5 considered as part of a herd of unknown status, until tested
  3  6 negative and vaccinated.
  3  7    Sec. 5.  Section 166D.10, subsection 6, Code 2001, is
  3  8 amended to read as follows:
  3  9    6.  Known infected swine moved through a fixed
  3 10 concentration point, other than a buying station of a
  3 11 slaughtering establishment, shall only be moved by restricted
  3 12 movement to a slaughtering establishment.
  3 13    Sec. 6.  Section 166D.12, subsection 2, paragraph c, Code
  3 14 Supplement 2001, is amended to read as follows:
  3 15    c.  (1)  A Except as provided in subparagraph (2), a person
  3 16 shall not move swine subject to restricted movement to or from
  3 17 a fixed concentration point or receive swine subject to
  3 18 restricted movement at a fixed concentration point, unless the
  3 19 swine is moved and received in compliance with section
  3 20 166D.10A.
  3 21    (2)  A person may move swine from a herd of unknown status
  3 22 from a fixed concentration point other than by restricted
  3 23 movement as provided in section 166D.10A, if the person moves
  3 24 the swine directly to another fixed concentration point or to
  3 25 a slaughtering establishment.
  3 26    Sec. 7.  EFFECTIVE DATE.  This Act, being deemed of
  3 27 immediate importance, takes effect upon enactment.
