PAG LIN 1 1 HOUSE FILE 2363 1 2 1 3 AN ACT 1 4 RELATING TO PERMITS FOR AND THE POSSESSION OF WEAPONS AND 1 5 PROVIDING PENALTIES. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 724.10, Code 2001, is amended to read 1 10 as follows: 1 11 724.10 APPLICATION FOR PERMIT TO CARRY WEAPONS CRIMINAL 1 12 HISTORY CHECK REQUIRED. 1 13 A person shall not be issued a permit to carry weapons 1 14 unless the person has completed and signed an application on a 1 15 form to be prescribed and published by the commissioner of 1 16 public safety. The application shall state the full name, 1 17social security number (optional)driver's license or 1 18 nonoperator's identification card number, residence, and age 1 19 of the applicant, and shall state whether the applicant has 1 20 ever been convicted of a felony, whether the person is 1 21 addicted to the use of alcohol or any controlled substance, 1 22 and whether the person has any history of mental illness or 1 23 repeated acts of violence. The applicant shall also display 1 24 an identification card that bears a distinguishing number 1 25 assigned to the card holder, the full name, date of birth, 1 26 sex, residence address, and a brief description and colored 1 27 photograph of the card holder.Upon notification that1 28criminal history data is available but not later than July 1,1 291991, theThe sheriff shall conduct immediately a criminal 1 30 history check concerning each applicant by obtaining criminal 1 31 history data from the department of public safety. A person 1 32 who knowingly makes a false statement of material fact on the 1 33 application commits a class "D" felony. 1 34 Sec. 2. Section 724.17, Code 2001, is amended to read as 1 35 follows: 2 1 724.17 APPLICATION FOR ANNUAL PERMIT TO ACQUIRE 2 2 CRIMINAL HISTORY CHECK REQUIRED. 2 3 The application for an annual permit to acquire pistols or 2 4 revolvers may be made to the sheriff of the county of the 2 5 applicant's residence and shall be on a form prescribed and 2 6 published by the commissioner of public safety. The 2 7 application shall state the full name of the applicant, the 2 8social securitydriver's license or nonoperator's 2 9 identification card number of the applicant, the residence of 2 10 the applicant, and the age of the applicant. The applicant 2 11 shall also display an identification card that bears a 2 12 distinguishing number assigned to the cardholder, the full 2 13 name, date of birth, sex, residence address, and brief 2 14 description and colored photograph of the cardholder, or other 2 15 identification as specified by rule of the department of 2 16 public safety.Upon notification that criminal history data2 17is available but not later than July 1, 1991, theThe sheriff 2 18 shall conduct a criminal history check concerning each 2 19 applicant by obtaining criminal history data from the 2 20 department of public safety. Section 724.19, Code 2001, is amended to read as 2 24 follows: 2 25 724.19 ISSUANCE OF ANNUAL PERMIT TO ACQUIRE. 2 26 The annual permit to acquire pistols or revolvers shall be 2 27 issued to the applicant immediately upon completion of the 2 28 application unless the applicant is disqualified under the 2 29 provisions of section 724.15 and shall be on a form prescribed 2 30 and published by the commissioner of public safety. The 2 31 permit shall contain the name of the permittee,the social2 32security number of the permittee,the residence of the 2 33 permittee, and the effective date of the permit. 2 34 Sec. 4. Section 724.26, Code 2001, is amended to read as 2 35 follows: 3 1 724.26 POSSESSION, RECEIPT, TRANSPORTATION,ANDOR 3 2 DOMINION AND CONTROL OF FIREARMS AND OFFENSIVE WEAPONS BY 3 3 FELONS. 3 4 A person who is convicted of a felony in a state or federal 3 5 court, or who is adjudicated delinquent on the basis of 3 6 conduct that would constitute a felony if committed by an 3 7 adult, and who knowingly has under the person's dominion and 3 8 control or possession, or receives, or transports or causes to 3 9 be transported a firearm or offensive weapon is guilty of a 3 10 class "D" felony. 3 11 Sec. 5.
