1 1 Section 1. Section 92.8, subsection 19, Code 2001, is
1 2 amended to read as follows:
1 3 19. Occupations involving exposure to lead fumes or its
1 4 compounds, or to dangerous or poisonous dyes or chemicals.
1 5 This subsection shall not be construed to include the use of
1 6 detergents, cleaners, and protectants in work involving motor
1 7 vehicle cleaning, washing, and polishing if the person
1 8 employed is provided with and uses personal protective
1 9 equipment as needed provided the person under eighteen years
1 10 of age shall not be employed or permitted to combine the
1 11 chemicals which constitute the detergents, cleaners, or
1 12 protectants used to wash, clean, or polish motor vehicles
1 13 other than to dilute the detergents, cleaners, and protectants
1 14 with water. However, use of a power washer, ladder, scaffold,
1 15 or their substitutes by a person employed in work involving
1 16 motor vehicle cleaning, washing, and polishing, who is
1 17 fourteen or fifteen years of age, is prohibited pursuant to
1 18 section 92.6, or rules adopted pursuant to section 92.6.
1 19 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 20 immediate importance, takes effect upon enactment.
1 21 EXPLANATION
1 22 This bill amends the child labor laws to provide that a
1 23 child under the age of 18 shall be permitted to use
1 24 detergents, cleaners, and protectants in motor vehicle
1 25 cleaning, washing, and polishing under certain conditions.
1 26 Current Code lists as a prohibited occupation for persons
1 27 under age 18 those occupations involving exposure to lead
1 28 fumes or its compounds, or to dangerous or poisonous dyes or
1 29 chemicals. The bill exempts from this prohibition the use of
1 30 detergents, cleaners, and protectants in work involving motor
1 31 vehicle cleaning, washing, and polishing, if the child
1 32 employed does not combine the chemicals, cleaners, and
1 33 protectants other than to dilute them with water and if the
1 34 child is provided with and uses personal protective equipment
1 35 as needed.
2 1 The bill also provides that use of a power washer, ladder,
2 2 scaffold, or their substitutes by a person 14 or 15 years of
2 3 age is prohibited.
2 4 The bill takes effect upon enactment.
