PAG LIN 1 1 Section 1. NEW SECTION. 152C.5A MASSAGE THERAPY 1 2 MODALITIES STUDY. 1 3 The Iowa department of public health, in conjunction with 1 4 the board, shall conduct a study regarding the modalities 1 5 associated with the practice of massage therapy. The study 1 6 shall be conducted with the input of licensed massage 1 7 therapists, reflexologists, and unlicensed persons practicing 1 8 modalities related to massage therapy. The objective of the 1 9 study shall be to determine which modalities shall be included 1 10 under the definition of massage therapy and require licensure. 1 11 The study shall focus on the health, safety, and welfare of 1 12 the public regarding each of the modalities reviewed. The 1 13 department shall submit a report summarizing the results of 1 14 the study and making recommendations regarding modality 1 15 inclusion to the general assembly by January 15, 2004. 1 16 Sec. 2. Section 152C.8, Code 2001, is amended to read as 1 17 follows: 1 18 152C.8 TRANSITION PROVISIONS. 1 19 1. An applicant for a license to practice massage therapy 1 20 applying prior to July 1,20022005, shall not be required to 1 21 meet the completion of curriculum of massage therapy 1 22 requirements contained in section 152C.3, subsection 1, 1 23 paragraph "a". The applicant shall, however, be required to 1 24 pass the board-approved national certification examination and 1 25 pay the applicable licensing fee. 1 26 2. Applicants with a license that has lapsed prior to July 1 27 1,20002002, who apply for reinstatement prior to July 1, 1 2820022005, shall be required to complete a reinstatement 1 29 application and pay a renewal fee and reinstatement fee 1 30 pursuant to section 147.11 and section 147.80, subsection 26. 1 31 Penalty fees otherwise incurred pursuant to section 147.10, 1 32 and continuing education requirements applicable to the period 1 33 prior to licensure reinstatement, shall be waived by the 1 34 board. 1 35 3. Applicants with a license that has lapsed prior to July 2 1 1,20002002, who do not apply for reinstatement prior to July 2 2 1,20022005, shall be required to apply for reinstatement in 2 3 accordance with lapsed license reinstatement provisions 2 4 established by rule of the board. 2 5 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 6 immediate importance, takes effect upon enactment. 2 7 EXPLANATION 2 8 This bill provides that the Iowa department of public 2 9 health, in conjunction with the board of examiners for massage 2 10 therapy, shall conduct a study regarding the modalities 2 11 associated with the practice of massage therapy. The bill 2 12 provides that the study shall be conducted with the input of 2 13 licensed massage therapists, reflexologists, and unlicensed 2 14 persons practicing modalities related to massage therapy. The 2 15 bill provides that the study's objective shall be to determine 2 16 which modalities shall be included under the definition of 2 17 massage therapy and, therefore, require licensure, and that 2 18 the study shall focus on the health, safety, and welfare of 2 19 the public regarding each of the modalities reviewed. The 2 20 bill provides for the submission of a report to the general 2 21 assembly by January 15, 2004. 2 22 The bill additionally provides for the extension of 2 23 transition provisions relating to licensure to practice 2 24 massage therapy, such that applicants shall not be required to 2 25 meet the completion of curriculum requirements contained in 2 26 Code section 152C.3, until July 1, 2005. 2 27 The bill provides an immediate effective date. 2 28 LSB 5144HH 79 2 29 rn/sh/8.1
