  1  1    Section 1.  Section 147.80, subsection 16, Code Supplement
  1  2 2001, is amended to read as follows:
  1  3    16.  License to practice barbering on the basis of an
  1  4 examination given by the board of barber examiners, license to
  1  5 practice barbering under a reciprocal agreement, renewal of a
  1  6 license to practice barbering, annual inspection by the
  1  7 department of inspections and appeals of barber school and
  1  8 annual inspection of barber shop, an original barber school
  1  9 license, renewal of a barber school license, transfer of
  1 10 license upon change of ownership of a barber shop or barber
  1 11 school, inspection by the department of inspections and
  1 12 appeals and an original barber shop license, renewal of a
  1 13 barber shop license, original barber school instructor's
  1 14 license, renewal of a barber school instructor's license,
  1 15 registration as an apprentice barber.
  1 16    Sec. 2.  Section 158.3, subsection 3, Code 2001, is amended
  1 17 to read as follows:
  1 18    3.  Notwithstanding the provisions of subsection 1,
  1 19 paragraph "a", any person who is registered as a barber's
  1 20 apprentice on the effective date of this chapter may apply to
  1 21 the department prior to October 1, 1976 and shall be issued a
  1 22 license to practice barbering upon payment of the fee
  1 23 prescribed under the provisions of section 147.80, and has
  1 24 successfully completed an apprentice program for barbers
  1 25 established pursuant to section 158.17, shall be deemed to
  1 26 have satisfied the course of study requirement for licensure.
  1 27    Sec. 3.  Section 158.8, Code 2001, is amended to read as
  1 28 follows:
  1 29    158.8  COURSE OF STUDY.
  1 30    The course of study of a barber school shall consist of at
  1 31 least two one thousand one five hundred hours of instruction
  1 32 as prescribed by the board and shall include instruction in
  1 33 all phases of the practice of barbering as defined in section
  1 34 158.1, subsection 1.  The course shall require at least ten
  1 35 months of instruction for completion.  The course shall
  2  1 include not less than three hundred hours of demonstrations
  2  2 and lectures in the following areas:  Law; ethics; equipment;
  2  3 shop management; history of barbering; sanitation;
  2  4 sterilization; personal hygiene; first aid; bacteriology;
  2  5 anatomy; scalp, skin, hair and their common disorders;
  2  6 electricity as applied to barbering; chemistry and
  2  7 pharmacology; scalp care; hair body processing; hairpieces;
  2  8 honing and stropping; shaving; facials, massage and packs;
  2  9 haircutting; hair tonics; dyeing and bleaching; instruments;
  2 10 soaps; and shampoos, creams, lotions, and tonics.  It shall
  2 11 include not less than one thousand four hundred hours of
  2 12 supervised practical instruction in the following areas:
  2 13 Scalp care and shampooing, honing and stropping, shaving,
  2 14 haircutting, hairstyling and blow waving, dyeing and
  2 15 bleaching, hair body processing, facials, massage and packs,
  2 16 beard and mustache trimming, and hairpieces.
  2 17    A person licensed under section 157.3 who enrolls in a
  2 18 barber school shall be granted full credit for each course
  2 19 successfully completed which meets the requirements of the
  2 20 barber school, which shall be credited toward the two one
  2 21 thousand one five hundred hour requirement, and the ten-month
  2 22 period does not apply.  A person who has been a student in a
  2 23 school of cosmetology arts and sciences licensed under chapter
  2 24 157 may enroll in a barber school and shall be granted, at the
  2 25 discretion of the school, at least half credit and up to full
  2 26 credit for each course successfully completed which meets the
  2 27 requirements of the barber school.
  2 28    Sec. 4.  Section 158.12, Code 2001, is amended to read as
  2 29 follows:
  2 30    158.12  LICENSE SUSPENSION AND REVOCATION.
  2 31    Any license or registration issued by the department under
  2 32 the provisions of this chapter may be suspended, revoked, or
  2 33 renewal denied by the board for violation of any provision of
  2 34 chapter 157 or this chapter or rules promulgated by the board
  2 35 under the provisions of chapter 17A.
  3  1    Sec. 5.  Section 158.13, subsection 1, Code 2001, is
  3  2 amended to read as follows:
  3  3    1.  It is unlawful for a person to employ an individual to
  3  4 practice barbering unless that individual is a licensed barber
  3  5 or has obtained a temporary permit.  It is unlawful for a
  3  6 person to employ an individual as an apprentice barber unless
  3  7 that individual is registered pursuant to section 158.17.  It
  3  8 is unlawful for a licensed barber to practice barbering with
  3  9 or without compensation in any place other than a licensed
  3 10 barbershop or barber school, or a licensed salon as defined in
  3 11 section 157.1, except that a licensed barber may practice
  3 12 barbering at a location which is not a licensed barbershop or
  3 13 barber school under extenuating circumstances arising from
  3 14 physical or mental disability or death of a customer.  It is
  3 15 unlawful for a licensed barber to claim to be a licensed
  3 16 cosmetologist, but it is lawful for a licensed barber to work
  3 17 in a licensed salon.
  3 18    Sec. 6.  NEW SECTION.  158.17  APPRENTICE PROGRAM FOR
  3 19 BARBERS – REGISTRATION.
  3 20    1.  The department shall establish an apprentice program
  3 21 for barbers.  The program shall consist of a minimum of one
  3 22 year of practical experience in the practice of barbering
  3 23 under the direct supervision of a licensed barber, and
  3 24 completion of a course of study in apprentice barbering as
  3 25 prescribed by the board by rule.  The course of study shall
  3 26 include but not be limited to demonstrations, lectures, and
  3 27 supervised practical instruction in scalp care, rinses, hair
  3 28 treatments, anatomy of scalp and hair and their common
  3 29 disorders, and sanitation and sterilization.  The board shall
  3 30 adopt rules defining the practices which an apprentice barber
  3 31 may perform, and at what point during an apprenticeship the
  3 32 practices may be performed.
  3 33    2.  An applicant for the apprentice program for barbers
  3 34 shall register with the board and pay a registration fee
  3 35 established as provided in section 147.80.  The applicant
  4  1 shall submit a statement from a supervising barber verifying
  4  2 the prospective apprenticeship and agreeing to terms of
  4  3 supervision and periodic evaluation of the apprentice as
  4  4 prescribed by the board by rule.
  4  5    Sec. 7.  Section 272C.2A, Code 2001, is amended to read as
  4  6 follows:
  4  7    272C.2A  CONTINUING EDUCATION MINIMUM REQUIREMENTS –
  4  8 BARBERING AND COSMETOLOGY ARTS AND SCIENCES.
  4  9    1.  The board of barber examiners and the board of
  4 10 cosmetology arts and sciences examiners, created pursuant to
  4 11 chapter 147, shall each require, as a condition of license
  4 12 renewal, a minimum of six hours of continuing education in the
  4 13 two years immediately prior to a licensee's license renewal.
  4 14 The board of cosmetology arts and sciences examiners may
  4 15 notify cosmetology arts and sciences licensees on a quarterly
  4 16 basis regarding continuing education opportunities.
  4 17    2.  Notwithstanding subsection 1, a licensed barber shall
  4 18 be exempt from additional continuing education requirements as
  4 19 a condition of license renewal provided that the licensee has
  4 20 continuously held a license to practice barbering in Iowa and
  4 21 been engaged in the practice of barbering in Iowa during the
  4 22 twenty-year period immediately preceding the licensure renewal
  4 23 date.  
  4 24                           EXPLANATION
  4 25    This bill provides for modifications relating to barbering
  4 26 licensure requirements and establishes an apprentice program
  4 27 for barbers.
  4 28    The bill provides that the course of study required for
  4 29 licensure as a barber shall consist of 1,500 hours of
  4 30 coursework, at least 1,000 hours of which shall be spent in
  4 31 supervised practical instruction.  Previously, these
  4 32 requirements were 2,000 and 1,400 hours, respectively.  The
  4 33 bill also provides that the course of study requirement shall
  4 34 not apply if an applicant for licensure has successfully
  4 35 completed an apprentice program for barbers.
  5  1    The bill provides that an apprentice program for barbers
  5  2 shall be established by the department of public health, and
  5  3 shall consist of a minimum of one year of practical experience
  5  4 in the practice of barbering under the direct supervision of a
  5  5 licensed barber, and completion of a course of study in
  5  6 apprentice barbering as prescribed by the board of barber
  5  7 examiners by rule.  The bill specifies a noninclusive list of
  5  8 course of study contents, and provides that the board shall
  5  9 establish by rule the practices which an apprentice barber may
  5 10 perform, and at what point during an apprenticeship they are
  5 11 authorized to perform them.  The bill provides that an
  5 12 applicant for the apprentice program for barbers shall
  5 13 register with the board and pay a registration fee established
  5 14 by the board.  The bill provides that the applicant shall
  5 15 submit a statement from a supervising barber verifying the
  5 16 prospective apprenticeship and agreeing to terms of
  5 17 supervision and periodic evaluation.  The bill makes
  5 18 conforming changes to Code chapter 158 relating to
  5 19 establishment of the apprentice program for barbers.
  5 20    The bill provides that the license suspension and
  5 21 revocation provisions of Code section 158.12, and the
  5 22 provisions specifying violations contained in Code section
  5 23 158.13, shall be applicable to apprentice barbers.
  5 24    The bill additionally provides for an exemption from
  5 25 continuing education requirements as a condition of license
  5 26 renewal for barbers under specified circumstances.  The bill
  5 27 provides that a barber shall be exempt from continuing
  5 28 education requirements if the barber has continuously held a
  5 29 license to practice barbering in Iowa and been engaged in the
  5 30 practice of barbering in Iowa during the 20-year period
  5 31 immediately preceding the licensure renewal date.
