1 4 RELATING TO JUDGMENT LIENS ATTACHING TO CITY REAL ESTATE.

1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 8 Section 1. Section 624.23, Code 2001, is amended by adding
1 9 the following new subsections:
1 10 NEW SUBSECTION. 5. A judgment lien attaching to the real
1 11 estate of a city may be discharged at any time by the city
1 12 filing with the clerk of the district court in which the
1 13 judgment was entered a bond in the amount for which the
1 14 judgment was entered, including court costs and accruing
1 15 interest, with surety or sureties to be approved by the clerk,
1 16 conditioned for the payment of the judgment amount, interest,
1 17 and court costs. If the real estate is located in a county
1 18 other than that in which the judgment was entered, the clerk
1 19 of the district court in which the judgment was entered shall
1 20 certify to the clerk of the district court of the county in
1 21 which the real estate is located that the bond has been filed.
1 22 NEW SUBSECTION. 6. A judgment against a city shall not
1 23 give rise to a lien attaching to the streets, alleys, or
1 24 utility easements of a city or attaching to the real estate of
1 25 a city which is used by the city for transportation, health,
1 26 safety, or utility purposes.
