PAG LIN 1 1 Section 1. 1995 Iowa Acts, chapter 195, section 37, as 1 2 amended by 1998 Iowa Acts, chapter 1209, section 40, is 1 3 amended to read as follows: 1 4 SEC. 37.ANIMAL AGRICULTUREECONOMIC AND ENVIRONMENTAL 1 5 CONSULTING ORGANIZATION ANIMAL AGRICULTURE. 1 6 1. The department of natural resources shall request that 1 7theorganizations enumerated in this section each appoint a 1 8 representative to an economic and environmental consulting 1 9 organization to consult with the department regarding the 1 10 economic and environmental impacts of departmental regulatory 1 11 actions upon animal agriculture. The department shall request 1 12 that the representatives provide the department with 1 13 recommendations regarding the adoption of rules required to 1 14 administer or enforce provisions in chapter 455B that affect 1 15 animal feeding operations. 1 16 2. a. The department shall request, subject to the 1 17 requirements of subsection 3, that each of the following 1 18 organizations appoint one member to represent the 1 19 organization: 1 20 (1) The Iowa pork producers association, the. 1 21 (2) The Iowa cattlemen's association, the. 1 22 (3) The Iowa poultry association, the. 1 23 (4) The Iowa dairy products association,. 1 24 (5) Iowa state university, the. 1 25 (6) The soil conservation division of the department of 1 26 agriculture and land stewardship, and the. 1 27 (7) The natural resources conservation service of the 1 28 United States department of agriculture, and after the1 29effective date of this section of this Act as amended by 19981 30Iowa Acts, House File 2494, two. 1 31 (8) The Iowa state association of counties. 1 32 (9) The environmental council. 1 33 (10) The department of economic development which shall 1 34 appoint a person with a special knowledge of tourism. 1 35 b. The department shall request that two organizations 2 1 representing agricultural producers generally each appoint one 2 2memberrepresentative to consult with the department. 2 3 3.The appointees shall consult with the department2 4regarding this Act, rules adopted pursuant to this Act, and2 5the Act's implementation.The representatives shall be 2 6 balanced by political party affiliation pursuant to section 2 7 69.16 and gender pursuant to section 69.16A. Representatives 2 8 shall not be reimbursed for their service or expenses. 2 9 4. The department shall consult with representatives in 2 10 meetings which shall be conducted by the department, upon the 2 11 call of the director of the department or the director's 2 12 designee, or upon the request to the department of any three 2 13 members.The department shall request that the2 14representatives provide the department with recommendations2 15regarding the adoption of rules required to administer this2 16Act.2 17 5. This section is repealed on March 31, 2005. 2 18 EXPLANATION 2 19 This bill amends provisions in Code chapter 455B regulating 2 20 animal feeding operations by the department of natural 2 21 resources including confinement feeding operations, originally 2 22 enacted in 1995 by House File 519 (1995 Iowa Acts, chapter 2 23 195) and amended in 1998 by House File 2494 (1998 Iowa Acts, 2 24 chapter 1209). Statutes regulating animal feeding operations 2 25 are divided in two places in Code chapter 455B: division II 2 26 which regulates air quality regulations (e.g., separation 2 27 distance requirements) and division III which regulates water 2 28 quality (e.g., construction permit and manure management plan 2 29 requirements). 2 30 In House File 519, the department of natural resources was 2 31 required to consult with a number of agricultural and 2 32 governmental organizations regarding the Act, rules adopted 2 33 pursuant to the Act, and the Act's implementation. The 2 34 organization is referred to as the animal agriculture 2 35 consulting organization (AACO). According to the 1995 3 1 legislation, AACO includes the Iowa pork producers 3 2 association, the Iowa cattlemen's association, the Iowa 3 3 poultry association, the Iowa dairy products association, an 3 4 organization representing agricultural producers generally, 3 5 Iowa state university, the soil conservation division of the 3 6 department of agriculture and land stewardship, and the 3 7 natural resources conservation service of the United States 3 8 department of agriculture. In House File 2494, the department 3 9 was required to invite a second organization representing 3 10 agricultural producers generally to appoint a representative. 3 11 The organization is abolished on March 31, 2005. 3 12 The bill changes the name of the organization to the 3 13 economic and environmental consulting organization. The bill 3 14 requires that the department invite three additional 3 15 organizations to appoint representatives, the Iowa state 3 16 association of counties, the environmental council, and the 3 17 department of economic development (appointing a person with a 3 18 special knowledge of tourism). The bill requires that the 3 19 organization be politically and gender balanced.
