1 1 Section 1. Section 602.8102, Code Supplement 2001, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 135C. Transmit civil penalties collected
1 4 from persons convicted of domestic abuse assault in violation
1 5 of section 708.2A to the state court administrator for deposit
1 6 in the victim compensation fund established in section 915.94.
1 7 Sec. 2. Section 708.2A, Code 2001, is amended by adding
1 8 the following new subsection:
1 9 NEW SUBSECTION. 10. A person convicted of violating this
1 10 section shall pay a mandatory civil penalty of five hundred
1 11 dollars in addition to any criminal fine and any criminal
1 12 sentence imposed. All civil penalties collected pursuant to
1 13 this subsection shall be paid to the clerk of the district
1 14 court, transmitted to the state court administrator, and
1 15 deposited in the victim compensation fund established in
1 16 section 915.94, to be used for providing services and support
1 17 to victims of domestic abuse or sexual assault as provided in
1 18 chapter 236.
1 19 EXPLANATION
1 20 This bill relates to the creation of a mandatory civil
1 21 penalty for persons convicted of domestic abuse assault in
1 22 violation of Code section 708.2A.
1 23 The bill provides that a person convicted of domestic abuse
1 24 assault shall pay a mandatory civil penalty of $500 in
1 25 addition to any criminal fine and any criminal sentence
1 26 imposed. The bill provides that all civil penalties collected
1 27 shall be paid to the clerk of the district court, transmitted
1 28 to the state court administrator, and deposited in the victim
1 29 compensation fund administered by the department of justice
1 30 pursuant to Code section 915.94, to be used for providing
1 31 services and support to victims of domestic abuse or sexual
1 32 assault as provided in Code chapter 236.
